05/03 APPLICATIONS FOR DEVELOPMENT

The Development Control Manager submitted a schedule of applications for development with his recommendations detailed thereon. In addition to the objections and representations detailed on the schedule, the Committee also considered further schedules of late objections/representations received, copies of which are attached to the signed minutes, which were circulated at the meeting.

RESOLVED:

That subject to the amendments set out below the recommendations of the Development Control Manager, as contained in the Schedule of Applications (a copy of which is attached to the signed minutes), be approved:

Item 10 02/1724/O - Field No. OS 3462 (land adjacent), Cruckmeole Farm, Shrewsbury: Delegate approval to Officers subject to the receipt and consent by the Local Planning Authority of plans amending the site access. Additional conditions would be attached to the permission restricting the dwelling to a bungalow with single storey living accommodation and that the applicant submit, for approval, existing and proposed land levels.

Item 12 02/1320/F - Bromley House, 96 Copthorne Road, Shrewsbury: Application refused for the following reasons:

(a) The proposal would result in an unneighbourly form of development in that it would lead to extra noise and disturbance from vehicular movements which the Local Planning Authority considers would be detrimental to the amenities which the occupiers of the adjoining property could reasonably expect to enjoy and is contrary to Policy GP4 of the Borough Local Plan.

(b) The proposed development would form a visually obtrusive feature by reason of its size and massing which the Local Planing Authority considers would be detrimental to the general character of the street scene and would be contrary to Policy GP4 of the Borough Local Plan.

(c) The car parking is insufficient for the amount of residential and sheltered accommodation and that the proposal would increase on street car parking to the detriment of the amenity of the residents of Lindale Court.

The Development Control and Environmental Protection Committee determined that the application be refused contrary to Officer advice.

Item 13 02/1473/F - Unit 11, Centurion Park (former M.O.D Depot), Kendal Road, Shrewsbury: Delete the contaminated land condition and add the following conditions:

(a) Construction of a wooden fence (planning permission reference 02/1477/TPO refers) be completed prior to the change of use of the building.

(b) A traffic light control at the junction of Kendal Road and Whitchurch Road be operational before any of the units are used.

    1. The sole vehicular access as shown on plan 09/02 received on 18th October 2002.

    2. The premises be used only between 08:00 to 17:00 Mondays to Fridays and 08:00 to 12:00 on Saturdays.

    3. The application is approved subject a S106 agreement.

 

Item 17 02/1553/F - Unit 4 Centurion Park, Kendal Road, Shrewsbury: Amend hours of operation to 08:00 hours to 17:00 hours Mondays to Fridays and 08:00 hours to 12:00 hours on Saturdays.

Item 18 02/1596/F - 251 Copthorne Road, Shrewsbury: Application refused for the following reason:

In the opinion of the Local Planning Authority the proposed extension, due to massing and scale would be out of scale with the existing dwelling and result in loss of visual amenity in the locality and hence contrary to Policy GP4 of the Borough Local Plan.

The Development Control and Environmental Protection Committee determined that this application be refused contrary to Officer advise for the reasons detailed above.

Item 19 02/1622/F - Municipal Golf Course, Oteley Road, Shrewsbury: Delegate approval to Officers subject to advertising of the application as a departure from the Borough Local Plan and no objections being received as a result of the advertisement.

The approval would also be subject to relevant highway conditions.

Item 25 02/1700/F - 1a Horsefair, Abbey Foregate, Shrewsbury: Include additional conditions relating to archaeology, doors and extractor units.

Item 26 02/1701/F - 1a Horsefair, Abbey Foregate, Shrewsbury: Include additional conditions relating to archaeology, doors and extractor units.

Item 28 02/1736/F - Stadco Ltd (Land adjacent, described as Longbow Close Office Park), Harlescott Lane, Shrewsbury: Application withdrawn by the applicant.

Item 29 02/1538/F - Land adjacent to 26 Hinwood Road, Westbury, Shrewsbury: Application refused for the following reasons:

(a) The proposal would result in a form of development having a cramped and overdeveloped appearance, which the Local Planning Authority considers would be visually detrimental to the general character of the street scene and would be contrary to Policy GP4 of the Borough Local Plan.

(b) The Local Planning Authority considers the proposal unacceptable in that it would result in the loss of car parking and hence is contrary to Policy GP1 of the Borough Local Plan.

The Development Control and Environmental Protection Committee determined that this application be refused contrary to Officer advise for the reasons detailed above.

Item 31 02/1651/O - 1 New Cottages (land adjacent), Windsor Lane, Bomere Heath, Shrewsbury: Application withdrawn by the applicant.

Item 33 02/1202/F - Land at Eaton Constantine (adjacent to Baxters House), Shrewsbury: Application approved:

    1. Subject to appropriate conditions.

    2. That the agricultural building (as approved in planning permission reference 02/1201/F) be constructed and completed prior to the start of development.

    3. That the application be advertised as a departure from the Borough Local Plan and no objections being received as a result of the advertisement.

The Development Control and Environmental Protection Committee determined that this applcation be approved contrary to Officer advise.

(Councillor R Jones wished that it be recorded that he had voted to refuse the application.)

Item 34 02/1551/ADV - Centurion Park, Kendal Road, Shrewsbury: Application withdrawn by the applicant.

 

06/03 CHANGES TO ENFORCEMENT PROCEDURE - LOCAL AUTHORITY AIR POLLUTION CONTROL

Consideration was given to a report from the Environmental Health Manager seeking approval for changes to enforcement procedures in respect of local authority air pollution control of industrial processes regulated under Part 1 of the Environmental Protection Act 1990 and informing members of proposals to develop an enforcement policy.

RESOLVED:

    1. That the enforcement procedure be changed so that Enforcement Notices are not served following contravention of authorisation conditions, but that the next step be either formal proceedings or the issuing of a warning, whichever is most appropriate in the particular circumstances of the case.

    2. That the Environmental Health Manager submit a comprehensive enforcement policy for member approval, once the details of the pollution prevention and control regime are finalised as official guidance from Central Government.

Consideration was given to an exempt report by the Development Control Manager in respect of development at 138 Ellesmere Road, Shrewsbury.

 

 

RESOLVED:

That the recommendation as detailed in paragraph 5.1 of the Development Control Manager's report be accepted.
