18/03 APPLICATIONS FOR DEVELOPMENT
The Development Control Manager submitted a schedule of applications for development with his recommendations detailed thereon. In addition to the objections and representations detailed on the schedule, the Committee also considered further schedules of late objections/representations received, copies of which are attached to the signed minutes, which were circulated at the meeting.

Minute 18/03 (Item 5) – Sainsbury’s Supermarket, Meole Brace, Shrewsbury Mr Dowell, Chairman of the Shrewsbury Town Centre Management Partnership spoke against the proposals and Mr Newton responded on behalf of the applicant.
Minute 18/03 (Item 10) – 2 Claremont Buildings, Claremont Bank, Shrewsbury Mr Mantell spoke against the proposals and Mr Warley responded on behalf of the applicant.
Minute 18/03 (Items 11 & 12) – 8 Mardol (The Music Bar), Shrewsbury Mr Peake spoke against the proposals. The applicant was not present.
RESOLVED:
That subject to the amendments set out below the recommendations of the Development Control Manager, as contained in the Schedule of Applications (a copy of which is attached to the signed minutes), be approved:
Item 5 02/0456/F - Sainsbury’s Supermarket, Meole Brace Retail Park, Hereford Road, Shrewsbury: The Development Control and Environmental Protection Committee considered that it was premature to take a decision on the application prior to:
(i) The completion of the Retail Capacity Study; and,
(ii) The outcome of the Tesco called-in planning application.
(Councillors Freestone, R Jones and Townsend requested that it be recorded that they voted against the resolution.)
Item 10 03/0189/F - 2 Claremont Buildings, Claremont Bank, Shrewsbury: Amend conditions as detailed in the schedule and include the following additional conditions:
1. The premises shall only be operated by "MIND" unless otherwise agreed in writing by the Local Planning Authority.
Reason: In order to ensure adequate controls over the operation of the premises to protect the residential amenity of the neighbouring properties.
2. Prior to the commencement of the development, full details of the proposed toilet provision (including disabled) within the premises shall be submitted for the prior approval of the Local Planning Authority and the approved details shall be fully implemented prior to the first use of the premises.
Reason: In order to ensure the satisfactory provision of toilet facilities of all users of the premises.
The Development Control Manager also informed the Committee that the listed bulding application referenced 03/0190/LB associated with the proposal was under consideration and was recommended for approval. The application was approved subject to the following conditions:
G01 – The development hereby permitted shall be begun before the expiration of five years from the date of the permission.
Reason: To comply with the provision of section 91 of the Town and Country Planning Act 1990.
G10I – The development hereby approved shall only be carried out in completed accordance with the submitted and approved plans, unless otherwise agreed in writing with the Local Planning Authority.
Reason: For the avoidance of doubt and to enable the Local Planning Authority to control the development in detail.
1. Prior to the commencement of the development, full details of the proposed toilet provision (including disabled) within the premises shall be submitted for the prior approval of the Local Planning Authority and the approved details shall be fully implemented prior to the first use of the premises.
Reason: In order to ensure the satisfactory provision of toilet facilities fo all users of the premises.
2. Prior to the commencement of the development full details of the proposed internal wall and door on the ground floor shall be submitted for the written approval of the Local Planning Authority and the approved scheme implemented prior to the first use of the building.
Reason: In order to protect the historic fabric inside the building.
Item 16 03/0013/F – Preston Gubbals Road/Windsor Lane (land between), Bomere Heath, Shrewsbury: The Development Control and Environmental Protection Committee were mindful to accept the Officers recommendation for refusal, however the application was withdrawn by the applicant prior to the meeting.
Item 17 03/0213/O – 1 New Cottages, Windsor Lane, Bomere Heath, Shrewsbury: Application deferred to enable officers to re-consult neighbours.
Item 18 03/0036/F – Wildes Plant Hire, Main Road, Dorrington: Application delegated to officers for approval subject to the satisfactory provision of affordable housing and in the event of further public consultation, the raising of no new planning objections (otherwise the application be referred back to Committee).
19/03 TREE PRESERVATION ORDERS
Consideration was given to a report from the Planning Policy Manager on various Tree Preservation Orders.
RESOLVED:
(a) That the following tree preservation orders be confirmed without modification:
(i) Shrewsbury & Atcham Borough Council (Oak Tree Drive Hanley Lane, Parrs Lane etc. Bayston Hill) Tree Preservation Order 2003; and
(ii) Shrewsbury & Atcham Borough Council (Land adjacent to Holyhead Road, Nesscliffe) Tree Preservation Order 2003.
(b) That the following tree preservation orders be confirmed with modification:-
(i) Shrewsbury & Atcham Borough Council (Mytton Oak Road) Tree Preservation Order 2002. Subject to an amendment to the species shown in the schedule for T4 to ‘Judas Tree’. (The tree T4 was incorrectly named ‘Strawberry Tree’ in the Planning Policy Manager’s report)
(ii) Shrewsbury & Atcham Borough Council (Falcons Way) Tree Preservation Order 2002. Subject to T3 being removed from the Order.
