43/03 APPLICATIONS FOR DEVELOPMENT

The Development Control Manager submitted a schedule of applications for development with his recommendations detailed thereon. In addition to the objections and representations detailed on the schedule, the Committee also considered further schedules of late objections/representations received, copies of which are attached to the signed minutes, which were circulated at the meeting.

The following Members spoke on the applications stated:

Councillor Clarke - Item 21, Land adjacent to Cross Lane, Bayston Hill.

Councillor Fox - Item 10, 54 Tudor Road, Shrewsbury.

The following members of the public were permitted to speak on the applications stated in accordance with the Council's scheme for public speaking on planning applications:

Application and Member of the public:

Minute 43/03 (item 10) – 54 Tudor Road, Shrewsbury. Mrs Brooks spoke against the application. The applicant was present but chose not to speak.

Minute 43/03 (item 13) – The Dolphin Public House, St Michael's Street, Shrewsbury. Mr Briody spoke against the application. The application was not present.

RESOLVED:

That subject to the amendments set out below the recommendations of the Development Control Manager, as contained in the Schedule of Applications (a copy of which is attached to the signed minutes), be approved:

Item 1 - 03/0836/F – The Cedars, Pecknall Lane, Halfway House, Shrewsbury: Delegate approval to officers after expiration of the consultation period on 31st July 2003, subject to no adverse comments being received.

Item 3 - 03/0830/F – 80 Lyth Hill Road, Bayston Hill, Shrewsbury: Include the following condition:

The rear side facing lounge window shall have obscure glazing and be kept permanently as such unless otherwise agreed in writing with the Local Planning Authority.

Reason: In order to protect the privacy of the adjoining property.

Item 5 - 03/0627/O – Ford Service Station, Ford: Application refused for the following reason:

In the opinion of the Local Planning Authority there is inadequate provision of customer parking which would result in a potential conflict with pedestrian and vehicles using and visiting the site to the detriment of pedestrian and highway safety and hence the proposal is contrary to Policy GP1 of the Borough Local Plan.and Policy P16 of the Shropshire and Telford and Wrekin Joint Structure Plan.

Furthermore there was a lack of a detailed formal traffic assessment which would enable the proper consideration of existing and proposed pedestrian and vehicular movements to and from the site and their impact on the access points to the site.

Item 8 - 03/0779/F – Longden C of E Primary School, Longden: Delegate approval to officers after expiration of the consultation period on 30th July 2003, subject to no adverse comments being received.

Item 13 - 03/0775/F – The Dolphin Public House, St Michaels Street, Shrewsbury: Delegate approval to officers after re-consultation of amended plans that had been received, subject to there being no new issues raised to the amended plans. Include additional standard conditions U24, U25 and informatives Z16 and Z19.

Item 24 - 03/0751/F – Home Farm, Leaton Knolls, Shrewsbury: Application withdrawn by the applicant.

Item 25 - 03/0856/O – New House Farm Site, Merrington Road, Bomere Heath: See Minute 44/03 below.

Item 26 - 03/0763/LB – Wisperwood, Shrawardine, Shrewsbury: The Development Control Manager informed the Committee that the officer recommendation as detailed in the schedule of applications had been changed from refusal to approval following receipt of amended plans. Members of the Development Control and Environmental Protection Committee agreed that the application be approved subject to appropriate conditions.

Item 27 - 03/0823/F – Wisperwood, Shrawardine, Shrewsbury: The Development Control Manager informed the Committee that the officer recommendation as detailed in the schedule of applications had been changed from refusal to approval following receipt of amended plans. Members of the Development Control and Environmental Protection Committee agreed that the application be approved subject to appropriate conditions.

Item 28 - 03/0634/CA – Rear of 44 Belle Vue Road, Shrewsbury: Application withdrawn by the applicant.

44/03 NEW HOUSE FARM SITE, MERRINGTON ROAD, BOMERE HEATH

Consideration was given to an outline application for the erection of 6 affordable and 12 open market dwellings including siting and means of access following demolition of existing derelict farm house and barns.

Mr Finney spoke in favour of the application. In accordance with the Council's scheme of public speaking on planning applications, the applicant was not permitted to speak.

The Chairman referred to the late letters of representation contained in the schedule of late letters circulated at the meeting.

Members had visited the site.

RECOMMENDED:

That planning permission for the following application be approved, subject to the appropriate conditions and a S106 legal agreement covering the provision of the affordable housing in accordance with the council's policy.

"New House Farm Site, Merrington Road, Bomere Heath – Outline application for the erection of 6 affordable and 12 open market dwellings including siting and means of access following demolition of existing derelict farm house and barns."

In the opinion of the Local Planning Authority, it was considered that the proposals were acceptable as they met the majority of the requirements of Policy HS7 of the Borough Local Plan and that there was a need for affordable accommodation within the area. The application would be advertised as a significant departure from the development plan and consideration be given to the application by the Planning Committee.

The Development Control and Environmental Protection Committee determined that the application be approved contrary to Officer advice for the reasons stated above.

(Councillor R Jones wished that it be recorded that he voted against the application.)

45/03 PIMLEY (LAND AT), SUNDORNE ROAD, SHREWSBURY

Consideration was given to a report by the Development Control Manager on amendments to planning application 01/0970/F for Pimley (Land at), Sundorne Road, Shrewsbury.

RESOLVED:

That the proposed amendments be accepted as a working amendment to planning permission 01/0970/F for Pimley (land at), Sundorne Road, Shrewsbury.

46/03 APPEAL DECISIONS

Consideration was given to appeal decisions in respect of the Prince Rupert Hotel, Shrewsbury, 9 Darwin Gardens, Shrewsbury, and Land at Lower Shadymoor Farm, Dorrington that had been received by the Development Control Manager.

RESOLVED:

That the appeal decisions in respect of the Prince Rupert Hotel, Shrewsbury, 9 Darwin Gardens, Shrewsbury and Land at Lower Shadymoor Farm, Dorrington be noted.
