47/03 APPLICATIONS FOR DEVELOPMENT

The Development Control Manager submitted a schedule of applications for development with his recommendations detailed thereon. In addition to the objections and representations detailed on the schedule, the Committee also considered further schedules of late objections/representations received, copies of which are attached to the signed minutes, which were circulated at the meeting.

Planning permission would be subject to the drawing up of a Section 106 Agreement relating to the provision of affordable housing and a commuted sum for off-site play area improvements.

Item 17 03/0943/F – 40 Longner Street, Shrewsbury: The Principal Planning Officer reported on a very late letter that had been received from the Environment Agency after the schedule of late letters circulated at the meeting had been produced and recommended that consideration of the application be deferred.

After due consideration it was agreed the application be deferred for further discussions between the applicant and the Environment Agency relating to the position of the development and the flood wall.

48/03 LAND BETWEEN WINDSOR LANE AND PRESTON GUBBALS ROAD, BOMERE HEATH, SHREWSBURY

Consideration was given to the following application:

"Land between Windsor Lane and Preston Gubbals Road, Bomere Heath, Shrewsbury - Variation of conditions 2 and 3 of planning permission 99/1047/VAR/268/83 granted on 15TH November 2000 (for the erection of sheltered housing and construction of new vehicular and pedestrian accesses) to allow a further 3 years for the submission of reserved matters (03/0724/VAR)"

The Chairman referred to the late letter of representation contained in the schedule of late letters circulated at the meeting.

RESOLVED:

That planning permission for the above application be refused for the reasons set out below:

In the opinion of the Local Planning Authority, in the absence of a Flood Risk Assessment for the proposed development, it has not been demonstrated that the site can be adequately developed for housing and thus the proposal is in conflict with Borough Local Plan Policy INF8.

The Development Control and Environmental Protection Committee determined that the application be refused contrary to Officer advice for the above reasons.

49/03 BATTLEFIELD ENTERPRISE PARK, BATTLEFIELD LINK ROAD, BATTLEFIELD SHREWSBURY

(Mr S Martin, representing the Campaign for the Protection of Rural England, spoke against the application and Ms T Cottle responded on behalf of the applicant, in accordance with the Council’s scheme for public speaking on planning applications.)

Consideration was given to a report by the Development Control Manager on an outline application for the use of land for organic and non-organic food related B1, B2 and B8 uses to include means of vehicular and pedestrian access at Battlefield Enterprise Park, Battlefield Link Road, Battlefield, Shrewsbury.

The Principal Planning Officer clarified that the reference in the report to "a height of 12 metres" was to eaves level.

The Chairman referred to the late letter of representation contained in the schedule of late letters circulated at the meeting.

Members had visited the site.

RESOLVED:

That the Development Control Manager advertise the following application as a departure from the Borough Local Plan and subject to no objections being received the Development Control Manager be authorised to determine approval of the application on the conditions referred to below:

"Battlefield Enterprise Park, Battlefield Link Road, Battlefield, Shrewsbury – Outline application for the use of land for organic and non-organic food related B1, B2 and B8 uses to include means of vehicular and pedestrian access (02/1429/O)"

Standard outline conditions would apply including provision of balancing pond, maximum ridge height, access details, flooding lighting, restricting use, structural landscaping and production of a Green Transport Plan.

50/03 11 SEVERN BANK, SHREWSBURY

(Mr Hitchcock spoke against the application in accordance with the Council’s scheme for public speaking on planning applications. The applicant was not present.)

Consideration was given to an application for the erection of a single storey rear extension following demolition of the existing flat roof extension and formation of a new vehicular access with gates and 2 parking spaces following partial demolition of the rear boundary wall at 11 Severn Bank, Shrewsbury.

The Chairman referred to the late letters of representation contained in the schedule of late letters circulated at the meeting.

RESOLVED:

  1. That the Development Control Manager approach the applicant to request the removal of the access/parking element from the proposed development and if the applicant does not accede to the request the Development Control Manager be authorised to determine refusal of the following application for the reasons set out below:
  2. "11 Severn Bank, Shrewsbury - Erection of a single storey rear extension following demolition of existing flat roof extension and formation of new vehicular access with gates and 2 parking spaces following partial demolition of rear boundary wall (03/0968/F)"

    In the opinion of the Local Planning Authority the proposed access and parking will result in increased highway dangers in the locality, detrimental to highway safety and the residential amenity of the neighbouring properties contrary to Borough Plan Policy GP1.

  3. That should the applicant accede to the request to remove the access/parking element from the proposed development the Development Control Manager be authorised to determine approval of that part of the application in (a) above relating to the single storey rear extension following demolition of the existing flat roof extension on the conditions referred to below:

In respect of (a) above, the Development Control and Environmental Protection Committee determined that the application be refused contrary to Officer advice for the reasons stated.

51/03 NEW OFFICES, FRANKWELL

Consideration was given to a report by the Development Control Manager on proposed amendments to the highway layout in respect of planning application 02/0355/F for new offices at Frankwell Quay, Frankwell, Shrewsbury.

RESOLVED:

  1. That the amended highway layout drawing 10020/7/3 received on 14th July 2003 be accepted as a working amendment to planning permission 02/0355/F for new offices at Frankwell Quay, Frankwell, Shrewsbury.
  2. That the Development Control Manager arrange for Members of the Committee and Substitutes to undertake a site visit of the new Council offices and the flood defence scheme.

52/03 APPEAL DECISION

Consideration was given to an appeal decision in respect of the Save Service Station, St Michael’s Street, Shrewsbury that had been received by the Development Control Manager.

RESOLVED:

That the appeal decision in respect of the Save Service Station, St Michael’s Street, Shrewsbury be noted.

53/03 EXEMPT MATTERS

RESOLVED:

That under Section 100A(4) of the Local Government Act 1972 the public be excluded from the meeting during consideration of the remaining items on the grounds that they could involve disclosure of Exempt Information as defined in Paragraphs 13 and 14 of Part 1 of Schedule 12A of the Act.

54/03 THE FLAXMILL, DITHERINGTON

Consideration was given to an exempt report by the Director of Development Services in respect of The Flaxmill, Ditherington, Shrewsbury.

RESOLVED:

That the recommendations as detailed in the exempt report be approved.

55/03 POST GRADUATE CENTRE, ROYAL SHREWSBURY HOSPITAL

Consideration was given to an exempt report by the Development Control Manager in respect of The Post Graduate Centre at the Royal Shrewsbury Hospital.

RESOLVED:

That option B as detailed in the exempt report be approved.

56/03 FURROWS, COTON HILL

(In the absence of the Chairman (Councillor Brennand) who had left the room due to his personal and prejudicial interest and the Vice-Chairman (Councillor Bebb) Councillor Mrs Allaway was appointed to chair the meeting for this item.)

Consideration was given to an exempt report by the Development Control Manager in respect of Furrows Limited, Coton Hill, Shrewsbury.

RESOLVED:

That the recommendations as detailed in the exempt report be approved.
