DEVELOPMENT CONTROL AND

ENVIRONMENTAL PROTECTION COMMITTEE

Meeting to be held in the Council Chamber, Oakley Manor, Belle Vue Road, Shrewsbury on Tuesday 23rd September 2003 at 5.30 p.m.

Site Visits from Oakley Manor at 10.00 a.m. (light refreshments will be provided for Members and Officers in the Committee Room from 5.00 p.m)

Members are respectfully reminded of the following planning procedure adopted by the Council:

1. The Development Control and Environmental Protection Committee will refer to the Planning Committee for determination:

(a) any proposed refusal of deemed planning permission or the reference back to the Cabinet of a decision to seek planning permission;

(b) and with reasons, any application for planning permission where the Committee is minded to approve the application contrary to the officer’s recommendation and where, if approved, the application would be a significant departure from the policies of the development plan.

(c) any controversial application which this committee has failed to determine.

2. That in the event of the Development Control and Environmental Protection Committee recommending the determination of an application for planning permission contrary to a development plan then the reason for so doing shall be minuted.

3. That where the Development Control and Environmental Protection Committee is minded to refuse an application for planning permission contrary to the officers recommendation then:

(a) the Committee shall specify as fully as possible the proposed grounds for refusal;

(b) the Solicitor in conjunction with the Development Control Manager shall be asked to consider whether any of the grounds for refusal are lawful and sustainable;

(c) If one or more grounds for refusal are lawful and sustainable the application shall be refused on the grounds stated;

(d) if none of the grounds are considered to be lawful and sustainable, the application shall be referred back to the Committee for determination at the next meeting with a report from the Solicitor.

4. That all correspondence received by members on current or forthcoming planning applications be forwarded to the Planning Department for details to be included in the officers’ report or schedule of late letters before return to members.

To receive any declarations of members’ interests in any matters which are to be considered at this meeting and to receive any dispensations which will be relied upon.

4. APPLICATIONS FOR DEVELOPMENT

The Chairman will propose that with regard to applications on the schedule of applications for development submitted by the Director of Development Services on which there is no debate, the recommendations of the Officers be deemed to have been accepted without any modifications.

    Recommendation:

    That the drawings received on the 15th August 2003, be accepted as an amendment to the planning permission 03/0583/ADV approved on 9th July 2003.

    Recommendation:

    That the proposed amendments shown on plans 636/01/3F, 636/01/4D, 636/01/6E received on the 22nd August 2003 and plan 636/01/5E received on the 29th August 2003 be accepted and approved.

    Recommendation:

    That S106 restriction limited the use of Harlescott House for elderly persons be removed.

    8. PUBLIC SPEAKING ON PLANNING APPLICATIONS

    To consider a report by the Chief Executive and Monitoring Officer.

    Recommendation:

    That consideration of making any changes to the scheme of public speaking in respect of planning applications be deferred until the results of the public consultation exercise on the Draft Statement of Community Involvement are known in order that all the issues surrounding public speaking can be considered at the same time.

    9. PLANNING APPEALS

    The following decisions of the Planning Inspectorate have been received by the Council regarding an appeal against a decision to refuse to grant planning permission.

    (a)1 Greenfield Street, Shrewsbury Reference 02/1337/F. Planning permission for the retention of 1.8m high wooden fence panels between concrete posts with gravel boards.

    Decision: Appeal dismissed 01 September 2003.

    Summary: The key issue was the effect of the proposal on the character and appearance of the surrounding area. The fencing was behind a raised brick wall, which gave an overall height of 2.3metres above pavement level. The surrounding area consisted of brick built properties with a mixture of walls and fences but in the vicinity of the appeal site the boundaries were primarily brick walls with half round coping less than 1.5metres high. The new fencing had a significant impact and was unduly prominent and out of character with the concrete posts being particularly incongruous.

    Note: Enforcement action now required.

    (b)William Lewis Toyota, Harlescott Lane Shrewsbury. Reference 03/0272/ADV. Planning permission for the erection of one illuminated "Hero" sign; 5 non-illuminated banners; 7 non-illuminated totem signs 2 metres high.

    Decision: A split decision was made allowing the "Hero" sign but dismissing the rest. Enforcement action is required against the unauthorised signs now displayed.

    Summary: The key issue was whether the signs would create advertisement clutter. The inspector concluded that the site was modest in size and the "Hero" sign set well back from the frontage was acceptable. The other signs were visually prominent close to the front boundary and led to a concentrated level of prominent display which overwhelmed the premises.

    Recommendation:

    That the appeal decisions in respect of 1 Greenfield Street, Shrewsbury and William Lewis Toyota, Harlescott Lane Shrewsbury, be noted.
