57/03 APPLICATIONS FOR DEVELOPMENT
The Development Control Manager submitted a schedule of applications for development with his recommendations detailed thereon. In addition to the objections and representations detailed on the schedule, the Committee also considered further schedules of late objections/representations received, copies of which are attached to the signed minutes, which were circulated at the meeting.

Minute 57/03 (item 11) –Integrated Waste Management Facility, Battlefield Enterprise Park. County Councillor I Jones made representations on the application and the Chief Engineer from Shropshire County Council responded.
Minute 57/03 (item 13) – 7 Stanton Green, Shrewsbury. Mr Davis objected to the proposals, the applicant was not present.
Minute 57/03 (item 14) – Bicton Heath Shopping Centre, Former Welsh Harp, Welshpool Road, Shrewsbury. Mr Kilby spoke in favour of the proposals and in accordance with the Council’s scheme on Public speaking on planning applications, the applicant was not permitted to speak.
Minute 57/03 (item 17) – Timberline, Old Coleham, Shrewsbury. Mrs Edwards spoke against the proposals, the applicant was not present .

RESOLVED:
That subject to the amendments set out below the recommendations of the Development Control Manager, as contained in the Schedule of Applications (a copy of which is attached to the signed minutes), be approved:

03/1046/F – Court Farm, Stapleton, Dorrington – Include additional condition to ensure that three open sides of the barn remain as such.Reason: To safeguard the visual amenities of the area.

03/0785/F – Land off Kendal Road, Shrewsbury – The Development Control Manager referred to a very late letter that had been received that had not been included in the Schedule of late letters that was circulated at the meeting.Members of the Committee agreed to delegate approval of the application to the Development Control Manager subject to a noise assessment being carried out.

03/1014/F – 70 Steepside, Shrewsbury – Include the following conditions:SO3: Before the development commences, details of the means of construction which safeguards the development from possible landfill gas shall be submitted to an approved by the Local Planning Authority, unless the Local Planning Authority are satisfied following the submission of results of investigations and tests for landfill gas that such safeguards are unnecessary.
Reason: The site lies within 250m of a landfill site and the Local Planning Authority wishes to ensure that the site can be developed and occupied with adequate regard to environment and public safety.
SO4: The development shall be carried out in strict accordance with any details submitted and approved under the forgoing condition.

03/1020/F – 89 Mount Pleasant Road, Shrewsbury – Include the following condition:U24: No development shall commence until a scheme for the fitting of odour control equipment to the process and/or building has been submitted to and approved in writing by the Local Planning Authority. The use of the premises shall not commence until all odour control equipment and works have been carried out in accordance with the agreed scheme. The odour control equipment shall be permanently retained and maintained thereafter in accordance with the agreed scheme.
Reason: To safeguard the amenities of the occupiers of adjoining properties.

Consideration was given to report by the Development Control Manager on amendments to planning permission reference 03/0583/ADV in respect of Unit 2A Archers Way, Battlefield Enterprise Park, Shrewsbury.
RESOLVED:
That the drawings received on the 15th August 2003, be accepted as an amendment to Planning Permission reference 03/0583/ADV that was approved on the 9th July 2003, in respect of Unit 2A Archers Way, Battlefield Enterprise Park, Shrewsbury.
59/03 HOLY CROSS RESIDENTIAL HOME, ABBEY FOREGATE
Consideration was given to report by the Development Control Manager on various amendments to planning permission reference 02/0569/F in respect of Holy Cross Residential Home, Abbey Foregate, Shrewsbury.
The Chairman referred to a late letter of representation contained in the schedule of late letters circulated at the meeting.
RESOLVED:
That the amendments to planning permission 02/0569/F for Holy Cross Residential Home, Abbey Foregate as shown on plans 636/01/3F, 636/01/4D and 636/01/6E received on the 22nd August 2003 and plan 636/01/5E received on the 29th August 2003, be approved, subject to a S106 legal agreement that would require the four additional windows to be non-opening, obscure glazed and retained as such.
60/03 HARLESCOTT HOUSE AND FORMOSA, HARLESCOTT LANE
Consideration was given to a report by the Development Control Manager on a request that had been received to vary a S106 legal agreement that was attached to Harlescott House and Formosa, Harlescott Lane.
RESOLVED:
(a) That the S106 restriction limiting the use of Harlescott House, Harlescott Lane for elderly people, be removed.
(b) That the S106 agreement relating to Formosa be removed.
61/03 PUBLIC SPEAKING ON PLANNING APPLICATIONS
Consideration was given to a joint report by the Chief Executive and Monitoring Officer on amendments to the public participation rules in respect of planning applications at Development Control and Environmental Protection Committee meetings.
RESOLVED:
That consideration of making any changes to the scheme of public speaking in respect of planning applications be deferred until the results of the public consultation exercise on the Draft Statement of Community Involvement are known, in order that all the issues surrounding public speaking can be considered at the same time.
52/03 APPEAL DECISION
Consideration was given to three appeal decisions in respect of 1 Greenfield Street, Shrewsbury, William Lewis Toyota, Harlescott Lane, Shrewsbury and Bridge Farm Barns, Stapleton, Shrewsbury, that had been received by the Development Control Manager.
RESOLVED:
That the appeal decision in respect of 1 Greenfield Street, Shrewsbury, William Lewis Toyota, Harlescott Lane, Shrewsbury and Bridge Farm Barns, Stapleton, Shrewsbury be noted.
