Members are respectfully reminded of the following planning procedure adopted by the Council: 1. The Development Control and Environmental Protection Committee will refer to the Planning Committee for determination: (a) any proposed refusal of deemed planning permission or the reference back to the Cabinet of a decision to seek planning permission; (b) and with reasons, any application for planning permission where the Committee is minded to approve the application contrary to the officer’s recommendation and where, if approved, the application would be a significant departure from the policies of the development plan. (c) any controversial application which this committee has failed to determine. 2. That in the event of the Development Control and Environmental Protection Committee recommending the determination of an application for planning permission contrary to a development plan then the reason for so doing shall be minuted. 3. That where the Development Control and Environmental Protection Committee is minded to refuse an application for planning permission contrary to the officers recommendation then: (a) the Committee shall specify as fully as possible the proposed grounds for refusal; (b) the Solicitor in conjunction with the Development Control Manager shall be asked to consider whether any of the grounds for refusal are lawful and sustainable; (c) If one or more grounds for refusal are lawful and sustainable the application shall be refused on the grounds stated; (d) if none of the grounds are considered to be lawful and sustainable, the application shall be referred back to the Committee for determination at the next meeting with a report from the Solicitor. 4. That all correspondence received by members on current or forthcoming planning applications be forwarded to the Planning Department for details to be included in the officers’ report or schedule of late letters before return to members. |

That the Minutes of the meetings of the Development Control and Environmental Protection Committee held on 23rd September 2003 be confirmed as a correct record and be signed by the Chairman.

To consider the schedule of applications for development submitted by the Director of Development Services.
The Chairman will propose that with regard to applications on the schedule of applications for development submitted by the Director of Development Services on which there is no debate, the recommendations of the Officers be deemed to have been accepted without any modifications.
5. TREE PRESERVATION ORDERS
To consider a report by the Development Control Manager.
Recommendation:
(a) That the variations to the following orders be confirmed without modification:-
(i) Shrewsbury & Atcham Borough Council (Oak Tree Drive, Hanley Lane, Parrs Lane etc., Bayston Hill) Tree Preservation Order 2003. Varied 2003.
(ii) The Shrewsbury & Atcham Borough Council (1 Shelton Oak Priory, Shelton, Shrewsbury) Tree Preservation Order 1995. Varied 2003.
(b)That the following order be confirmed without modification:-
(i) The Shrewsbury & Atcham Borough Council (1 Berwick Road) Tree Preservation Order 2003.
(c)That the variation to the following order be confirmed with modification to the map location shown for T2.
(i)The Shrewsbury & Atcham Borough Council (Land off Wheathill Rise, Bomere Heath) Tree Preservation Order 1994. Varied 2003.

To consider a report by the Development Control Manager.
Recommendation:
That the drawings received on the 8th September 2003, be accepted and written consent be given for the erection of the carport.
7. PLANNING APPEALS
The following decisions of the Planning Inspectorate have been received by the Council regarding appeals against a decision to refuse to grant planning permission.
(a) Former Coffee Republic 31/32 Pride Hill, Shrewsbury
. Ref 02/0011/ENFDecision
: A partial award of costs has been made to the council after the withdrawal of an appeal against an enforcement notice served by the council.Summary:
The Inspectorate considered that the appellant was unreasonable in the late withdrawal of the appeal which was also to be heard by way of an Informal hearing. The primary reason given by the appellant was the decision to close the premises and cease trading. The inspector believed that this factor would have been known well in advance of the date of the hearing and decision to withdraw.(b) 28 Pulley Lane, Bayston Hill, Shrewsbury.
Ref 02/1467/FErection of a dormer window to the rear of the property in connection with a loft conversion.
Decision:
Appeal dismissedSummary:
The key issues were the loss of privacy to the neighbour and the visual impact of the large dormer on the building.(c) Rear of 13-15 Beech Close Hanwood.
Appeal against the councils refusal of a application to fell 2 lime trees covered by the Hanwood TPO 1968Decision:
The Sec of state agreed with the Inspecting officer and dismissed the appeal.Summary:
The key issue was whether the size and impact of the tree was detrimental to the properties and whether remedial works to the trees was a better way of dealing with the problems of debris and inconvenience. The officer believed that deadwood and ivy could be removed and that surgery could significantly improve the situation. The trees made an important contribution to the landscape and their removal would have a significant adverse affect on the local environment.(d) Cross Gates Barn, Ford, Shrewsbury.
Ref:03/0330/F Single storey extension to provide a utility area.Decision:
Appeal dismissed 19/9/03Summary:
The key issues were whether the proposal was essential for the proper functioning of the building and the effect on the character of the barn. The Inspector considered relevant planning policies and PPG 7. He concluded that there was no convincing reason for the extension although the existing utility was small. The joining of the garage to the dwelling with the extension would be harmful to the traditional character of the barn and give it a suburban appearance.(e) 20-22 Chester Street Shrewsbury.
Ref 02/1464/F Construction of 4 flatsDecision:
Appeal Allowed subject to conditions 24/9/03Summary:
The key issue was whether the proposal would place future residents and the emergency services at an unacceptable degree of risk at times of flood. The Inspector concluded that the benefits of recycling brownfield land and the enhancement of the conservation area outweighed the flood risk issue. He felt that the existence of an escape plan was important as were minimum standards of flood defence. The floor level was above the 1 in 100 flood level and the Environment Agency has warning measures in place. The reuse of the property for residential was not acceptable but a commercial building was acceptable to the agency. He also referred to the recent appeal decision at Broome Place for one dwelling and felt this was a material consideration.Recommendation:
That the appeal decisions in respect of the following applications be noted.
