5. PLANNING APPEALS
The following decisions of the Planning Inspectorate have been received by the Council regarding appeals against a decision to refuse to grant planning permission.
(a) 77 Falcons Way Shrewsbury Erection of a rear conservatory. Ref 03/0483/F
Decision
: Allowed subject to conditions 31/10/03 (Officer recommendation to approve with conditions).Summary:
The key issue was the effect on the living conditions of the neighbouring property. The Inspector considered that the relationship of the conservatory to the neighbour and the use of obscure glazing on the side elevation would not result in unacceptable loss of privacy to the neighbour’s property. The lightweight construction and distance to the neighbour’s property would also result in little loss of daylight.(b) Gable Cottage, 7 Upper Longwood, Eaton Constantine.
Erection of a two storey extension. Ref 02/1461/FDecision
: Appeal dismissed 13/10/03Summary:
The key issue was the effect on the character and appearance of the house and the wider countryside. The Inspector agreed that the extension would extend the house significantly (up to 300%) and was disproportionate to the existing dwelling. It would alter the shape and form of the dwelling, which was part of its charm and character. Although the extension would be largely hidden in a large plot PPG7 emphasise that the countryside should be protected for its own sake and that development should be strictly controlled.(c) 44 Roman Road, Shrewsbury
Erection of two storey extension and detached garage. Ref 02/1638/FDecision
: Appeal dismissed 10/10/03 (Officer recommendation to approve).Summary:
The key issues were the effects of the development on the character and appearance of the area and the implications for the living conditions and privacy of neighbours. The Inspector agreed that the design was not compatible with the existing and its impact was harmful to the character of the area. On the issue of living conditions/privacy he accepted that the proposal would not unacceptably harm neighbouring properties.Recommendation:
That the appeal decisions in respect of 77 Falcons Way, Shrewsbury, Gable Cottage, 7 Upper Longwood, Eaton Constantine and 44 Roman Road, Shrewsbury be noted.
