DEVELOPMENT CONTROL AND

ENVIRONMENTAL PROTECTION COMMITTEE

Meeting to be held in the Council Chamber, Oakley Manor, Belle Vue Road, Shrewsbury on Tuesday 16th December 2003 at 5.30 p.m.

Site Visits from Oakley Manor at 10.00 a.m. (light refreshments will be provided for Members and Officers in the Committee Room from 5.00 p.m)

Members are respectfully reminded of the following planning procedure adopted by the Council:

1. The Development Control and Environmental Protection Committee will refer to the Planning committee for determination:

a. any proposed refusal of deemed planning permission or the reference back to the Cabinet of a decision to seek planning permission;

b. and with reasons, any application for planning permission where the Committee is minded to approve the application contrary to the officer’s recommendation and where, if approved, the application would be a significant departure from the policies of the development plan.

c. any controversial application which this committee has failed to determine.

2. That in the event of the Development Control and Environmental Protection Committee recommending the determination of an application for planning permission contrary to a development plan then the reason for so doing shall be minuted.

3. That where the Development Control and Environmental Protection Committee is minded to refuse an application for planning permission contrary to the officers recommendation then:

a. the Committee shall specify as fully as possible the proposed grounds for refusal;

b. the Solicitor in conjunction with the Development Control Manager shall be asked to consider whether any of the grounds for refusal are lawful and sustainable;

c. If one or more grounds for refusal are lawful and sustainable the application shall be refused on the grounds stated;

d. if none of the grounds are considered to be lawful and sustainable, the application shall be referred back to the Committee for determination at the next meeting with a report from the Solicitor.

4. That all correspondence received by members on current or forthcoming planning applications be forwarded to the Planning Department for details to be included in the officers’ report or schedule of late letters before return to members.

Recommendation:

That the Minutes of the meetings of the Development Control and Environmental Protection Committee held on 25th November 2003 be confirmed as a correct record and be signed by the Chairman.

3. DECLARATIONS OF INTEREST AND DISPENSATIONS

To receive any declarations of members’ interests in any matters which are to be considered at this meeting and to receive any dispensations which will be relied upon.

When members are declaring a personal interest, or a personal and prejudicial interest in respect of which they have dispensation, they should specify the nature of such interest. Members should leave the room if they have a personal and prejudicial interest in respect of which they do not have a dispensation.

4. APPLICATIONS FOR DEVELOPMENT

To consider the schedule of applications for development submitted by the Director of Development Services.

The Chairman will propose that with regard to applications on the schedule of applications for development submitted by the Director of Development Services on which there is no debate, the recommendations of the Officers be deemed to have been accepted without any modifications.

Recommendation:

That amendments shown on plans referenced 04B/AY/1103 and 05B/AY/1103 received on 7th November 2003 be accepted and approved.

6. FRANKWELL QUAY, SHREWSBURY

To consider a report by the Development Control Manager.

That the amendments to the access road layout and underground car park as shown on plan 258/03/PE.86 and 10020/4/17 be approved.

7.PLANNING APPLICATIONS ON PUBLISHED COMMITTEE AGENDA AND RECEIPT OF AMENDED PLANS

To consider a report from the Development Control Manager.

Recommendation:

(a) On publication of the committee agenda, no amendments would be accepted which would necessitate public reconsultation and a change in officer recommendation.

(b) That all local agents be advised of the change of procedures and be invited to respond to requests for amendments well in advance of the publication of the agenda.

8. PLANNING APPEALS

The following decision of the Planning Inspectorate has been received by the Council regarding appeals against a decision to refuse to grant planning permission.

(a) 5 Lower Road, Pontesbury Hill, Shrewsbury - Appeal against two conditions on planning permission 02/1500/F dated 28th Oct 2002

Decision: Appeal Dismissed - 19/11/2003

Summary: The Inspector considered that the key issues were the protection of the living conditions of occupiers of adjoining properties and ensuring a satisfactory appearance for the development. On the first issue the dwelling to the rear of the proposed bungalow was overlooked by the property and it was important that the Council had control over the insertion of dormer windows to the rear. On the second issue the front of the site was exposed and had little natural vegetation present. The requirement for a landscaping scheme was therefore appropriate. He concluded that both of the councils proposed conditions were necessary and satisfied the legal tests.

9. EXEMPT ITEM

The Chief Executive will report that the following item relates to exempt matters under Part I of Schedule 12A of the Local Government Act 1972, the Sub-Committee will be asked to consider passing the following resolution:

RESOLVED:

That, under Section 100A(4) of the Local Government Act 1972, the public be excluded from the meeting during consideration of the remaining items on the grounds that they could involve the disclosure of exempt information as defined in Paragraph 12 of Part 1 of Schedule 12A of the Act.

10. THE STORES, HANWOOD

To consider an exempt report by the Development Control Manager.

Recommendation:

The recommendation is detailed in the exempt report.
