10. PLANNING APPEALS
The following decision of the Planning Inspectorate has been received by the Council regarding appeals against a decision to refuse to grant planning permission.
(a) Land near The Grove Buildwas Shrewsbury
– Appeal against refusal of planning permission 03/0324/F for the use of land for the provision of a settled gypsy site.Decision:
Appeal dismissed – 15.01/2004Summary:
The location of the site out of the village which had now lost its shop provision would make the site dependent on the car for most journeys. Although the village was walkable the lack of adequate pavement would make it unlikely. The proposal was not therefore sustainable and conflicted with national and local policy advice. On the second matter the location was visible and the siting of up to 3 caravans plus vehicles and domestic paraphernalia could not be adequately screened; the idea of having fencing with trellis would also be prominent and inappropriate. Finally the location next to a road with a national speed limit (60mph) with cars negotiating the nearby bend at high speeds made the use of the existing access a concern. This was not helped by the types of vehicles with caravans that would be using the site. The inspector did recognise the particular circumstances of the family and the importance of a stable family life and opportunity for the children to attend school. However greater weight was given to the guidance in Circular1/94 (Gypsy Developments) that as a rule it will not be appropriate to make provision for gypsies in AONB's.
