Minute 06/04 (item 8) – Brittania Bank (Longmynd Travel), Shrewsbury – Personal interest in that the Director of the company concerned was known to him but not sufficiently well as to prevent him from taking part in the consideration of and voting on the application.

Minute 06/04 (item 7) – Hawthorne Lodge, Pontesbury Hill, Shrewsbury – Personal and prejudicial interest in that he had previously made representations with regard to all future development within Pontesbury. He left the room and took no part in the consideration of and voting on the application.

06/04 APPLICATIONS FOR DEVELOPMENT

The Development Control Manager submitted a schedule of applications for development with his recommendations detailed thereon. In addition to the objections and representations detailed on the schedule, the Committee also considered further schedules of late objections/representations received, copies of which are attached to the signed minutes, which were circulated at the meeting.

Members had made visits to the following sites prior to the start of the meeting:

Minute 06/04 (items 4 & 5) – Land between Preston Gubbals Road and Windsor Lane, Bomere Heath, Shrewsbury Mr Browning spoke against the proposals and Mr Pollock, the applicant’s agent responded.

Minute 06/04 (item 7) – Hawthorne Lodge, Pontesbury Hill, Pontesbury Mr Stanworth spoke against the proposals and Mr Wellings, the applicant, responded.

Minute 06/04 (item 11) – 11 Woodlark Close (side of), Shrewsbury Mr Burke spoke against the proposals. The applicant was not present.

RESOLVED:

That subject to the amendments set out below the recommendations of the Development Control Manager, as contained in the Schedule of Applications (a copy of which is attached to the signed minutes), be approved:

Item 4 03/1486/F - Land between Preston Gubbals Road and Windsor Lane, Bomere Heath: Members of the Development Control and Environmental Protection Committee determined that the application be refused for the following reason:

The proposal would result in the loss of open space important in this locality and the local community and be contrary to Planning Policy Guidance Note No.17 (Planning for Open Space, Sport and Recreation) and policy HS3 of the Borough Local Plan.

Members of the Committee refused the application contrary to Officer advice.

Item 5 03/1487/F - Land between Preston Gubbals Road and Windsor Lane, Bomere Heath: Members of the Development Control and Environmental Protection Committee determined that the application be refused for the following reason:

The proposal would result in the loss of open space important in this locality and the local community and be contrary to Planning Policy Guidance Note No.17 (Planning for Open Space, Sport and Recreation) and policy HS3 of the Borough Local Plan.

Members of the Committee refused the application contrary to Officer advice.

Item 7 03/1481/F – Hawthorne Lodge, Pontesbury Hill, Pontesbury: Include the following additional condition and informative:

"Before any works on the boundary would commence, a design and check certificate for the boundary wall should be submitted to and agreed in writing with the Local Planning Authority. The boundary wall shall be constructed in accordance with the agreed standards (in the interest of highway safety).

Informative: The County Council Highways Services comments are attached for information."

07/04 BERWICK GRANGE, BATTLEFIELD, SHREWSBURY

Consideration was given to a report by the Development Control Manager on amendments that had been received in respect of planning permission 98/806/RM/117/94 for Berwick Grange, Battlefield, Shrewsbury. The amendments were for the repositioning of a toddlers play area which had been a requirement of the S106 agreement that was attached to the planning permission.

RESOLVED:

That the amendments as detailed on drawing 4-030-8-Play Area 03 received on the 6th October 2003 in respect of planning permission 98/806/RM/117/94 approved on 27th January for Berwick Grange, Shrewsbury not be accepted and that Officers be requested to:

i. Enquire as to whether the developers would be prepared to commute the sum of £26,000 and for this amount to be ring fenced for community benefits within the Berwick Grange area.

ii. Liase with the Borough Council’s Community Services Directorate as to whether a consultation exercise/open day could be arranged with the residents of Berwick Grange to determine the best way forward.

08/04 CONSULTATION ON REMOVAL OF BRITISH TELECOM PAYPHONES

The Development Control Manager reported that following a British Telecom review of the local payphone network, the Council had been consulted on the closure of a payphone in Roushill, Shrewsbury.

RESOLVED:

That the Local Planning Authority raise objections to the removal of the payphone in Roushill, Shrewsbury and that British Telecom be requested to remove the payphone in Mardol Head/Shoplatch, Shrewsbury in its place.

09/04 CATERPILLAR, LANCASTER ROAD, SHREWSBURY

Consideration was given to a report by the Development Control Manager on amendments that had been received in respect of planning permission 03/0262/F for Caterpillar, Lancaster Road, Shrewsbury.

RESOLVED:

That the plans and letter received on the 15th January 2004 detailing increased diameter and relocation of three stacks be accepted as a minor amendment to planning permission 03/0262/F for Caterpillar, Lancaster Road, Shrewsbury.

10/04 TIMBERLINE, OLD COLEHAM, SHREWSBURY

Consideration was given to a report by the Development Control Manager on amendments that had been received in respect of planning permission 03/1037/VAR for Timberline, Old Coleham, Shrewsbury.

RESOLVED:

That the amendments to the requirements of conditions 8 and 10 attached to planning permission 03/1037/VAR for Timberline, Old Coleham, Shrewsbury with one month to complete the proposed works and with the erection of suitable signs to indicate the new arrangements to customers/deliveries be accepted.

11/04 TREE PRESERVATION ORDERS

Consideration was given to a report by the Planning Policy Manager on various Tree Preservation Orders.

RESOLVED:

(a) That the variation to the following order be confirmed without modification:-

Shrewsbury & Atcham Borough Council (26 Havelock Road, Belle Vue, Shrewsbury) Tree Preservation Order 1995 Varied 2003.

(b) That the following order be confirmed with modification:-

Shrewsbury & Atcham Borough Council (St Mary’s Water Lane) Tree Preservation Order 1972 Varied 2003. Subject to an amendment to the description of the species and location of T2 to read ‘European Ash’ and ‘On land at or adjacent to No.1 Council House Court’

12/04 PLANNING APPEALS

Consideration was given to an appeal decision in respect of Land near The Grove, Buildwas, Shrewsbury (Planning permission 03/0324/F), that had been received by the Development Control Manager from the Planning Inspectorate.

RESOLVED:

That the appeal decision for planning permission 03/0324/F for Land near The Grove, Buildwas, Shrewsbury be noted.

13/04 EXEMPT MATTERS

RESOLVED:

That under section 100A (4) of the Local Government Act 1972, the public be excluded from part of the meeting during consideration of the following item on the grounds that it could involve the disclosure of exempt information as defined in Paragraphs 13 and 14 of Part 1 of Schedule 12A of the Act.

 

14/04 3 STRICKLAND, HARLESCOTT, SHREWSBURY

Consideration was given to an exempt report by the Development Control Manager in respect of 3 Strickland, Harlescott.

RESOLVED:

That the recommendation as detailed in paragraph 5.1 of the exempt report be accepted.
