18/04 APPLICATIONS FOR DEVELOPMENT

The Development Control Manager submitted a schedule of applications for development with his recommendations detailed thereon. In addition to the objections and representations detailed on the schedule, the Committee also considered further schedules of late objections/representations received, copies of which are attached to the signed minutes, which were circulated at the meeting.

Members had made visits to the following sites prior to the start of the meeting:

  • The Oceans, Pontesbury Hill, Pontesbury, Shrewsbury

  • Mayfield House (land adjacent), David Avenue, Pontesbury, Shrewsbury

  • Land adj The Lion Public House, Hinwood Road, Westbury, Shrewsbury

  • Bicton House, Holyhead Road, Bicton, Shrewsbury

  • 32 Moreton Villas, Moreton Crescent, Shrewsbury

Mrs Chandler spoke against the proposals and the applicant Mr Mark Devine responded.

RESOLVED:

That, subject to the amendments set out below, the recommendations of the Development Control Manager, as contained in the Schedule of Applications (a copy of which is attached to the signed minutes), be approved:

 

Item 7 04/0075/F - The Oceans, Pontesbury Hill, Pontesbury, Shrewsbury, Shropshire, SY5 0XH

Include the following additional conditions:

Inclusion of a 2.4m high fence shall be erected along the boundary with Hebron in accordance with details to be submitted to and agreed in writing with the Head of the Local Planning Authority and the agreed scheme completed before the use of the extensions commence and thereafter permanently retained.

Reason: In order to protect the privacy of the occupiers of Hebron.

 

Item 8 03/1676/F - Plots 6 and 7 Vanguard Business Park, Shrewsbury

Include the following additional conditions:

Other than shown on the submitted red approval plan no other engineering works shall be undertaken within or structures erected on the land shown potentially for use as a Rail Freight Depot without the prior written permission of the Head of the Local Planning Authority.

Reason: In order to protect the area of land shown within the Development Plan for use as a Rail Freight Depot.

 

Item 9 04/0059/F - Shropshire Dairies, Mercian Close, Longden Road, Meole Brace, Shrewsbury

To amend the local community comments in the Officers report to indicate that four letters received from four households on Adswood Grove objecting to the development.

 

Item 10 04/0079/F - 32 Moreton Villas, Moreton Crescent, Shrewsbury, Shropshire, SY3 7BZ

The Development Control Manager stated that the application site was within the conservation area.

The Development Control and Environmental Protection Committee determined that the application be refused for the following reasons:

In the opinion of the Planning Authority the proposed extension will cause unacceptable loss of light and be visually overbearing to the occupier of the adjoining dwelling and hence the proposal is contrary to Policy GP1 of the Borough Local Plan

 

Item 14 04/0183/F - Land adj to unit F at Lower House Farm, Stoney Stretton, Shrewsbury, Shropshire

Authority delegated to the Development Control Manager to approve the application subject to bunding to the north and east of the site within the curtilage of the site and the return of land to agriculture when change of use ceases.

Reason: The Committee felt that the proposal did not cause significant detrimental effects on the countryside subject to adequate screening.

 

19/04 IMPLEMENTING DEVELOPMENT CONTROL BEST VALUE REVIEW

Consideration was given to a report by the Development Control Manager on progress with the implementation of the Best Value Improvement Plan for the Development Control Service.

RECOMMENDED:

That the Cabinet be asked to approve the following amendments to local performance indicator targets for the Development Control Service:

  1. The target for booking in Planning Applications within 5 working days being amended from 100% to 95%.

  2. The target for dispatching Planning Decision Notices being amended from 100% to 95%.

  3. The target for responding to letters be amended to 90% within 10 working days which reflects the number of reply letters received by Development Control and also the prioritising of work on a 3 week committee cycle.

 

20/04 SECTION 106 LEGAL AGREEMENT LOW COST HOUSING AT SHRAWARDINE

Consideration was given to a report by the Development Control Manager on a request to vary the Section 106 Legal Agreement relating to the low cost housing at Shrawardine.

RESOLVED:

That the S106 Legal Agreement be amended to allow 100% purchase of the owner occupied properties on the basis that any future sales of the properties be based on the Borough Local Plan (or equivalent policy document) average male earnings figure.

 

21/04 ARTICLE 4 DIRECTIONS

The Committee noted that a report by the Conservation Officer on Article 4 Directions and the need for equality would be submitted to their meeting scheduled to be held on 27th April 2004.

 

22/04 PLANNING APPEALS

Consideration was given to appeal decisions in respect of The Wain House, Berrington (03/0879/F & 03/0847/LB) and 1 and 2 Greenfield Street, Shrewsbury (03/0393/F) that had been received by the Development Control Manager from the Planning Inspectorate.

RESOLVED:

That the appeal decisions for planning permissions 03/0879/F and 03/0847/LB for The Wain House, Berrington and 03/0393/F for 1 and 2 Greenfield Street, Shrewsbury be noted.
