45/04 APPLICATIONS FOR DEVELOPMENT
The Development Control Manager submitted a schedule of applications for development with his recommendations detailed thereon. In addition to the objections and representations detailed on the schedule, the Committee also considered further schedules of late objections/representations received, copies of which are attached to the signed minutes, which were circulated at the meeting.
Members had made visits to the following sites prior to the start of the meeting:

RESOLVED:
That, subject to the amendments set out below, the recommendations of the Development Control Manager, as contained in the Schedule of Applications (a copy of which is attached to the signed minutes), be approved:
Item 7 04/0863/F - Stable Views, Alderton, Shrawardine, Shrewsbury
Application deferred to enable Members of the Development Control and Environmental Protection Committee to visit the site.
Item 9&10 04/0776/F - 8 Lake Cottages, Asterley, Shrewsbury
Include the following additional conditions:
Notwithstanding the submission of the additional site plan on 27th July 2004, prior to the commencement of the Development, full details of the proposed ground level alterations required to construct the garage and driveway including the formation of any associated hard surfaces shall be submitted for the prior written approval of the Local Planning Authority and the scheme implemented in accordance with the approved details.
REASON: In order to construct the garage at an appropriate level with regards to the adjacent highway.
The existing hedge and embankment to the frontage shall be retained unless proposals have been approved for their alteration by the Local Planning Authority.
REASON: In the interest of visual amenity.
The existing access shall be retained and not altered unless details of any proposed alterations have been submitted for approval and agreed by the Local Planning Authority and implemented prior to the first use of the garage.
REASON: In the interest of highway safety.
Members of the Committee agreed with the Officer recommendations that the application be approved

To amend the description in the Officers Report as detailed in the Schedule of Applications as follows:
Conversion of the Old Guildhall into a single dwelling, conversion and extension to Guildhall Coach House into 3 no. dwellings, conversion and extension of 10 St Marys Street into 1 no. dwelling, conversion of 1 St Marys Court into 4 no. apartments,conversion of 17 Dogpole into 2 no dwellings, 16 Dogpole into 1 no dwelling and erection of 2 no. dwellings, with associated parking and landscaping of site in the grounds
Item 16 04/00724/F - Land Adjoining The Onslow Public House Car Park, Pensfold, Gains Park, Shrewsbury
The Development Control and Environmental Protection Committee determined that the application be refused for the following reasons:
REASON: In the opinion of the Local Planning Authority and in view of the submitted highway and parking information, the applicant has failed to demonstrate that the proposal would not give rise to indiscriminate parking on Penfold to the detriment of highway interests and is therefore contrary to Joint Structure Plan Policy P15 and the Borough Local Plan Policy GP1.
Members of the Committee determined that the application be refused contrary to Officer advice for the above reason.
46/04 HOLY TRINITY CHURCH, MEOLE BRACE, SHREWSBURY - ERECTION OF AN EXTENSION TO PROVIDE A NEW COMMUNITY HALL AND ANCILLARY CHURCH ACCOMMODATION
Consideration was given to a report by the Development Control Manager confirming details of the proposed users of the new community hall considered and approved by the Committee on the 25th May 2004.
The Chairman referred to letters contained in the Schedule of Additional Letters circulated at the meeting.
RESOLVED:
The building be used for those who currently use the Church Hall (senior citizens, pram club, children’s holiday club, Sunday School, youth congregation, alpha courses and Parish Council Committee meetings). The building will also be used for developing Community uses such as adult education, health and social service clinics, lunch clubs, youth clubs, drop in sessions, school use and local clubs and associations. Wedding receptions would only be held when the ceremony has taken place in the Holy Trinity Church in accordance with Condition 16 of the planning approval reference 04/0140/F
47/04 OAKRILL, HOPTON, NEAR NESSCLIFFE, SHREWSBURY
Consideration was given to a report prepared by the Development Control Manager outlining the current situation in relation to two planning applications considered by the Committee at its meeting on the 16th February 1999 at Oakrill, Hopton, Near Nesscliffe in respect of retaining agricultural land at existing levels and retaining the tennis court as residential curtilage.
RESOLVED:
(a) That planning permission be granted to application number 99/1009 subject to standard conditions and the erection of a boundary fence to delineate the residential curtilage; and
(b) That planning permission be granted to application number 99/1012 subject to standard conditions and the retention of the existing landscaping around the tennis court.
48/04 CONSULTATION FROM BRITISH TELECOM ON PAYPHONES IN SHREWSBURY AND ATCHAM DISTRICT
The Development Control Manager reported that following a British Telecom review of the local payphone network, the Council had been consulted on the closure of a number of payphones in the Shrewsbury and Atcham District.
RESOLVED:
(a) The Council raises no objection to the loss of the identified payphones in Shrewsbury and Bayston Hill and would support the removal of a payphone at Whitchurch Road / Hawkestone Road and at Monkmoor Road / Crowmere Road / Racecourse Avenue and seek the retention of the payphone at Monkmoor Road / Racecourse Crescent; and
(b) The Council regrets the loss of the rural payphones where no other such phone exists within walking distance, would seek the retention of the payphone at Albrighton, Shrewsbury and would endorse any comments submitted by the Parish Councils to British Telecom.
49/04 ARTICLE 4 DIRECTION IN SHREWSBURY TOWN CENTRE AND BELLE VUE CONSERVATION AREA
Consideration was given to a report prepared by the Planning Policy Manager requesting approval to withdraw specified permitted development rights for selected dwelling houses within Shrewsbury Town Centre and Belle Vue conservation areas to help fulfil the Council’s requirement to have special regard to the preservation and enhancement of its conservation areas.
RESOLVED:
That the five existing Article 4 Directions in Belle Vue, Mountfields, Castlefields, Cherry Orchard and St Julian’s are replaced with a Direction under Article 4(2) of the General Permitted Development Order 1995 withdrawing permitted development rights as set out in Annex C of the Report.
50/04 PLANNING APPEALS
Consideration was given to appeal decisions in respect 18 Sunfield Park, Shrewsbury (03/0754/TPO), Land at Old ROC Post Church Road, Dorrington, Shrewsbury (99/054/ENF), Land at the Fields, Off Beehive Lane, Kingsland Road, Shrewsbury (03/1337/F), St Annes, South Hermitage, Shrewsbury (03/1351/F), Land at Ruckley Barn, Ruckley, Shrewsbury (03/1572/F) and River Heights, 7 Darwin Gardens, Mountfields (03/1246/TPO) that had been received by the Development Control Inspectorate and noted with particular regard the success rate for the Council in the appeal decisions.
RESOLVED:
That the appeal decisions for the following be noted:
- 03/0754/TPO 18 Sunfield Park, Shrewsbury;
- 99/054/ENF Land at Old ROC Post Church Road, Dorrington;
- 03/1337/F Land at The Fields, Off Beehive Lane, Kingsland Road, Shrewsbury;
- 03/1351/F St Annes, South Hermitage, Shrewsbury;
- 03/1572/F Land at Ruckley Barn, Ruckley, Near Shrewsbury; and

51/04 EXEMPT MATTERS
RESOLVED:
That under section 100A (4) of the Local Government Act 1972, the public be excluded from the meeting during consideration of the following item on the grounds that it could involve the disclosure of exempt information as defined in Paragraph 13 of Part 1 of Schedule 12A of the Act.
52/04 ENFORCEMENT OF ARTICLE 4 DIRECTIONS IN CONSERVATION AREAS
Consideration was given to an exempt report by the Planning Policy Manager to review the effectiveness and enforceability of Article 4 Directions as they apply to properties within conservation areas.
RESOLVED:
That the recommendations as detailed in the exempt report be approved.
