DEVELOPMENT CONTROL AND

ENVIRONMENTAL PROTECTION COMMITTEE

Meeting to be held in the Council Chamber, The Guildhall, Frankwell Quay, Shrewsbury on Tuesday 5th October 2004 at 5.30 p.m.

Site Visits from The Guildhall at 10.00 a.m. (light refreshments will be provided for Members and Officers in the Staff Room from 5.00 p.m.)

Members are respectfully reminded of the following planning procedure adopted by the Council:

1.  The Development Control and Environmental Protection Committee will refer to the Planning Committee for determination:

  1. any proposed refusal of deemed planning permission or the reference back to the Cabinet of a decision to seek planning permission;

  1. and with reasons, any application for planning permission where the Committee is minded to approve the application contrary to the officer’s recommendation and where, if approved, the application would be a significant departure from the policies of the development plan.

  2. any controversial application which this committee has failed to determine.

2.    That in the event of the Development Control and Environmental Protection Committee recommending the determination of an application for planning permission contrary to a development plan then the reason for so doing shall be minuted.

3.    That where the Development Control and Environmental Protection Committee is minded to refuse an application for planning permission contrary to the officers recommendation then:

  1. the Committee shall specify as fully as possible the proposed grounds for refusal;
  2. the Solicitor in conjunction with the Development Control Manager shall be asked to consider whether any of the grounds for refusal are lawful and sustainable;
  3. If one or more grounds for refusal are lawful and sustainable the application shall be refused on the grounds stated;
  4. if none of the grounds are considered to be lawful and sustainable, the application shall be referred back to the Committee for determination at the next meeting with a report from the Solicitor.

4. That all correspondence received by members on current or forthcoming planning applications be forwarded to the Planning Department for details to be included in the officers’ report or schedule of additional letters before return to members.

Recommendation:

That the Minutes of the meeting of the Development Control and Environmental Protection Committee held on 14th September 2004 be confirmed as a correct record and be signed by the Chairman.

4. APPLICATIONS FOR DEVELOPMENT

To consider the schedule of applications for development submitted by the Development Control Manager.

The Chairman will propose that with regard to applications on the schedule of applications for development submitted by the Development Control Manager on which there is no debate, the recommendations of the Officers be deemed to have been accepted without any modifications.

 

5. DITHERINGTON FLAX MILL

To consider the Report of the Director of Development Services.

Recommendations:

1. i) That a Compulsory Purchase Order be made for land adjacent to the Flaxmill, Ditherington, Shrewsbury and identified on the plan attached as Appendix 3 for the purpose of the improvement of the social, economic and environmental well-being of the area under Section 226 of the Town and Country Planning Act 1990 as amended by the Planning and Compulsory Purchase Act 2004; and,

ii)  that the Director of Development Services be authorised to negotiate and purchase the land described in (i) above by agreement concurrently with CPO action; and,

iii)  that (i) and (ii) above be subject to the Council making appropriate provision in the capital programme

2.  That, subject to any comments the Committee may wish to make, Cabinet be recommended to support for adoption by the Council the Ditherington Flaxmill Masterplan Study prepared by Fielden Clegg Bradley (May 2004) as Supplementary Planning Guidance in order to provide the necessary planning framework to guide the repair and re-use of the Flaxmill and development in the vicinity of the Flaxmill.

 

6. WHARFSIDE, BERWICK WHARF, NEAR SHREWSBURY

Wharfside Report

To consider the Report of the Development Control Manager.

Recommendations:

  1. That the revised proposals shown on plans, 649.9.02 Rev B, 642.8.01 Rev B received on the 19th August 2004 be treated as an acceptable amendment.

  2. That the applicant writes to confirm he will carry out the requirements of the S106 agreement for these amendments.


7. PLANNING APPEALS

The following decisions of the Planning Inspectorate have been received by the Council regarding appeals against a decision to refuse to grant planning permission:

(a) Site at rear of 31 Belle Vue Road, Shrewsbury - Erection of a pair of starter homes with siting and access. Ref 03/1490/O

Decision: Appeal dismissed 13 September 2004

Summary: The key issues were the impact on the conservation area and the amenities of neighbouring properties. The Inspector considered that the introduction of the dwellings into part of an undeveloped rear garden would not preserve or enhance the character of the conservation area. On the issue of impact on neighbours, the dwellings would be overlooked by existing properties and additional screening would itself be likely to be intrusive. The location to the rear of the site would involve vehicle movements alongside buildings that have permission for conversion to four dwellings; this was likely to result in disturbance to a degree that was unacceptable. The reuse of a brownfield site in itself was not a justification for approval.

(b) Site at the Village Shop, Upton Magna - Erection of a single storey extension to provide additional tea room space Ref 03/1358/F

Decision: Dismissed 13 September 2004

Summary: The key issue was the design of the extension and its effect on the appearance and character of the area. The site was in the conservation area and this proposal was designed to match the existing building. The visual impact from the west would be substantial and create a departure from the pattern of development on the estate. The proposal conflicted with policy GP4 and it would not enhance/preserve the conservation area. The need for the extension also seemed to be flawed and did not appear to be essential for the continuing functioning of the building but more a desirable request. Access to the business park would also be obstructed to a degree but this point was not raised by either party so was not a material factor for the inspector.
