58/04 APPLICATIONS FOR DEVELOPMENT
(Councillor Ms Wild was not in attendance for Minute 58/04 (Items 6 to 10; Items 13 to 28) in its entirety, Minute 59/04, Minute 60/04 and Minute 61/04 and took no involvement in the discussion or decision made by the Committee on the applications.)
The Development Control Manager submitted a schedule of applications for development with his recommendations detailed thereon. In addition to the objections and representations detailed on the schedule, the Committee also considered further schedules of additional objections/representations received, copies of which are attached to the signed minutes, which were circulated at the meeting.
Members had made visits to the following sites prior to the start of the meeting:

Councillor Bebb indicated that in relation to Item 4 - Railway Inn, Station Road, Pontesbury he had previously made representations declaring that he was against any development in Pontesbury until the sewerage issues were rectified. In accordance with paragraphs 8.7 and 8.8 of the Local Protocol for Councillors and Officers dealing with Planning Matters, he made a statement on the application and then left the Chamber and took no part in the consideration of and voting on the application.

RESOLVED:
That, subject to the amendments set out below, the recommendations of the Development Control Manager, as contained in the Schedule of Applications (a copy of which is attached to the signed minutes), be approved:

Include the following additional condition:
Muster station provision to be provided for the children and staff of the Wakeman School during the construction period.
Reason: To ensure the safety of the children and staff of the Wakeman School during the construction period.
Item 10 04/1044/F - 5, 6 and 7 St Austin Street, Shrewsbury
Include the following additional conditions:
The lower 6 panes of the two rear top floor windows shall be obscure glazed and permanently retained as such,
Reason: To protect the privacy of the neighbouring properties.
The proposed rear flat roof to the top floor of the flat block shall not be enclosed or have access in any way or to be used as a roof terrace.

Item 24 04/1094/F - Land adj Hillcrest, Preston Gubbals Road, Bomere Heath, Shrewsbury
Following a site visit, Members of the Committee expressed concern at the scale and design of the development and felt that the proposal would overlook neighbouring properties and would be overbearing.
Members of the Development Control and Environmental Protection Committee determined that the application be refused and the following additional conditions for refusal be included:
The proposed backland development would result in an unneighbourly form of development in that it would lead to overlooking which the Local Planning Authority considers would be detrimental to the amenities which the occupiers of the adjoining property could reasonably expect to enjoy and is contrary to Policy GP1 of the Borough Local Plan.
The proposed backland two storey dwelling would be visually overbearing and dominant from neighbouring bungalows and would be detrimental to the amenities that the occupiers of those bungalows could reasonably expect to enjoy and is contrary to Policy GP1 of the Borough Local Plan.
The proposed backland two storey dwelling would be of a scale and design which is harmful to the character and appearance of this part of Bomere Heath and contrary to Policy HS3 of the Borough Local Plan.
Item 27 04/1017/F - Barns adjacent to Hill Top Farm, Sheinton, Shropshire
The application was withdrawn by the applicant.
59/04 DITHERINGTON FLAX MILL
Consideration was given to the report by the Director of Development Services in relation to the Flax Mill Master Planning proposals and the benefits of using compulsory purchase powers to regenerate the Flax Mill Area.
RESOLVED:
a. i) That a Compulsory Purchase Order be made for land adjacent to the Flaxmill, Ditherington, Shrewsbury and identified on the plan attached as Appendix 3 of the Report for the purpose of the improvement of the social, economic and environmental well-being of the area under Section 226 of the Town and Country Planning Act 1990 as amended by the Planning and Compulsory Purchase Act 2004;
ii) That the Director of Development Services be authorised to negotiate and purchase the land described in (i) above by agreement concurrently with CPO action; and
iii) That (i) and (ii) above be subject to the Council making appropriate provision in the capital programme
b. That Cabinet be recommended to support for adoption by the Council the Ditherington Flaxmill Masterplan Study prepared by Fielden Clegg Bradley (May 2004) as Supplementary Planning Guidance in order to provide the necessary planning framework to guide the repair and re-use of the Flaxmill and development in the vicinity of the Flaxmill.
60/04 WHARFSIDE, BERWICK WHARF, NEAR SHREWSBURY
Consideration was given to the report by the Development Control Manager in relation to an amendment to planning permission 02/0370/F seeking a reduction in the projecting decking area, reduction in projecting extension and partial reduction in roof height of the conservatory / sunlounge at Wharfside, Berwick Wharf.
RESOLVED:
a. That the revised proposals shown on plans, 649.9.02 Rev B, 642.8.01 Rev B received on the 19th August 2004 be treated as an acceptable amendment to planning permission 02/0370/F.
b. That the applicant be requested to write confirming he will carry out the requirements of the S106 agreement for these amendments.
61/04 PLANNING APPEALS
Consideration was given to two appeal decisions by the Planning Inspectorate in respect of a site at the rear of 31 Belle Vue Road, Shrewsbury Ref 03/1490/O and a site at the Village Shop, Upton Magna Ref 03/1358/F which had been received by the Development Control Manager.
RESOLVED:
That the decision of the Planning Inspectorate for the appeals regarding the site at the rear of 31 Belle Vue Road, Shrewsbury and a site at the Village Shop, Upton Magna be noted.
