AGENDA
1. MINUTES - 5th October 2004
Recommendation:
That the Minutes of the meeting of the Development Control and Environmental Protection Committee held on 5th October 2004 be confirmed as a correct record and be signed by the Chairman.
2. APOLOGIES FOR ABSENCE/NOTIFICATION OF SUBSTITUTES
3. DECLARATIONS OF INTEREST AND DISPENSATIONS
To receive any declarations of members' interests in any matters which are to be considered at this meeting and to receive any dispensations which will be relied upon.
(a) Personal (b) Personal and Prejudicial
When members are declaring a personal interest, or a personal and prejudicial interest in respect of which they have dispensation, they should specify the nature of such interest. Members should leave the room if they have a personal and prejudicial interest in respect of which they do not have a dispensation.
4. APPLICATIONS FOR DEVELOPMENT
To consider the schedule of applications for development submitted by the Development Control Manager.
The Chairman will propose that with regard to applications on the schedule of applications for development submitted by the Development Control Manager on which there is no debate, the recommendations of the Officers be deemed to have been accepted without any modifications.
5. QUARRY VIEW, KINGSLAND, SHREWSBURY (FORMERLY LAND REAR OF 10 LONGDEN ROAD)
To consider the Report of the Development Control Manager.
Recommendations:
The east side elevation bedroom window and 2 velux rooflights on the east roof elevation shown on the amended plan received on the 13th October 2004 are acceptable as amendments.
6. TREE PRESERVATION ORDERS
To consider the Report of the Planning Policy Manager.
Recommendations:
- That the variation to the Shrewsbury and Atcham Borough Council (Shelton Hospital No 3) Tree Preservation Order 2003, varied 2004 be confirmed without modification
- That the Shrewsbury and Atcham Borough Council (The Grange, Eaton Constantine) Tree Preservation Order 2004 be confirmed without modification
- That the Shrewsbury and Atcham Borough Council (Land at or adjacent to Wheathill Rise, Bomere Heath) Tree Preservation Order 1994, Varied 2004 be confirmed subject to an amendment to the species shown in the schedule for T5 to 'Liriodedron chinense' and T7 and T8 being removed from the order.
7. CONSULTATIONS ON HEAVY GOODS VEHICLE LICENCE APPLICATIONS
To consider the Report of the Development Control Manager.
Recommendations:
- Only Parish Councils who are not able to electronically receive A's and D's or access will be notified of such proposals in their area.
- If valid objections to A's and D's are received within 14 days of their publication and after consultation with Legal Services, the Council will raise objections with the Traffic Commissioners.
8. LOCAL AIR QUALITY AND ASSESSMENT AIR QUALITY MANAGEMENT AREAS - DRAFT ACTION PLAN
To consider the Report of the Environmental Health Manager.
Recommendations:
(i) The Final Draft AQAP be formally adopted and submitted to DEFRA for approval;(ii) Subject to approval by DEFRA, the AQAP be published and made available on the Council's website
(iii) Implementation of the measures commences in partnership with Shropshire County Council and the other organisations identified in the AQAP;
(iv) Pollutant monitoring continues, including the use of the real time mobile air quality monitoring station and that appropriate budgetary provision continues (and that capital costs be identified for future replacement, if necessary, of the station).
(v) That budgetary provision of £10,000 be made for 2005 to cover specialist pollutant modelling work in respect of the AQAP. Further that the next round of review and assessment commences in 2007 and that budgetary provision of £20,000 be made to cover specialist pollutant modelling work.
(vi) That a further report be made to members in respect of the enlarged town centre AQMA, conclusions of the work on PM10 and SO2 and revised AQAP
9. CYCLE OF MEETINGS
To consider the Report of the Development Control Manager.
Recommendation:
That the cycle of meetings for the Development Control and Environmental Protection Committee be generally set at 4 weekly intervals after the next Annual Council meeting.
10. PLANNING APPEALS
The following decisions of the Planning Inspectorate have been received by the Council regarding appeals against a decision to refuse to grant planning permission:
Site at The Whitehorse Public House, Wenlock Road, Shrewsbury - Erection of various signs on the building and the forecourt Ref 04/0404/ADV
Decision: Appeal part approved (signs 5, 7 and11) part refused (sign 9)
Summary: The signs 5, 7 and 11 were considered to be acceptable as they were largely replacement of existing signs and their location set back from the road reduced their impact. Sign 9 was on the building and facing the roundabout and on these grounds its visual impact was greater and on an elevation that was much more subdued resulted in the sign looking out of place.
Land at Mansion View, Ford, Shrewsbury - Appeals against the erection of a single storey extension to form a sun room Ref 03/0787/F and 03/0842/LB
Decision: Both appeals dismissed 11 October 2004
Summary: The decisions by the Secretary of State, following his Inspector's findings, were based on the unacceptable design and appearance of the extension which would be detrimental to the setting of the nearby Grade II* Mansion House. The fully hipped design would disrupt the lines of the listed building and intrude into the space between the buildings. In addition he considered the extension unnecessary to fulfill the criteria of the relevant policies. The Council had referred to the use of the garage attached to the building as a possible alternative and this was a material consideration which further emphasised the inappropriateness of the application.
11. EXEMPT ITEMS
The Chief Executive will report that the following items relate to exempt matters under Part I of Schedule 12A of the Local Government Act 1972, the Committee will be asked to consider passing the following resolution:
RESOLVED:
That, under Section 100A(4) of the Local Government Act 1972, the public be excluded from the meeting during consideration of the remaining item on the grounds that it could involve the disclosure of exempt information as defined in Paragraphs 13 and 14 of Part 1 of Schedule 12A of the Act.
