62/04 TREE PRESERVATION ORDERS

Consideration was given to the report of the Planning Policy Manager in respect of trees covered by Tree Preservation Orders at Shelton Hospital No 3, The Grange, Eaton Constantine and land at or adjacent to Wheathill Rise, Bomere Heath.

RESOLVED:

    1. That the variation to the Shrewsbury and Atcham Borough Council (Shelton Hospital No 3) Tree Preservation Order 2003, varied 2004 be confirmed without modification

    2. That the Shrewsbury and Atcham Borough Council (The Grange, Eaton Constantine) Tree Preservation Order 2004 be confirmed without modification

    3. That the Shrewsbury and Atcham Borough Council (Land at or adjacent to Wheathill Rise, Bomere Heath) Tree Preservation Order 1994, Varied 2004 be confirmed subject to an amendment to the species shown in the schedule for T5 to 'Liriodedron chinense' and T7 and T8 being removed from the order.

The Development Control Manager submitted a schedule of applications for development with his recommendations detailed thereon. In addition to the objections and representations detailed on the schedule, the Committee also considered further schedules of additional objections/representations received, copies of which are attached to the signed minutes, which were circulated at the meeting.

RESOLVED:

That, subject to the amendments set out below, the recommendations of the Development Control Manager, as contained in the Schedule of Applications (a copy of which is attached to the signed minutes), be approved:

Item 5 04/1305/F - The Broad Meadow, Leebotwood, Church Stretton, Shropshire

Include the following additional conditions:

Dedicated access road markings through the public house car park to be undertaken and the access road to be kept clear at all times.

Reason: To achieve a satisfactory road access layout and in the interest of highway safety.

The caravan is not to be used for permanent residential use.

Reason: No proven need for permanent residential caravan and hence contrary to planning policy.

Item 6 04/1324/F - 9 & 10 Main Road (Off Manor Park) Pontesbury

The Development Control and Environmental Protection Committee determined that the application be refused for the following reason:

In the opinion of the Local Planning Authority the proposed dwelling is out of scale and character and design on this plot and would result in overlooking of nearby properties and be overbearing and hence contrary to Policy GP1 of the Borough Local Plan.

Members of the Committee determined that the application be refused contrary to Officer advice for the above reasons.

The Development Control and Environmental Protection Committee determined that the application be refused for the following reason:

In the opinion of the Local Planning Authority the proposed reduced height of the fence would form a visually obtrusive feature by reason of its siting which would be detrimental to the general character of the street scene and would be contrary to Policy GP1 of the Borough Local Plan.

Members of the Committee determined that the application be refused contrary to Officer advice for the above reasons.

Item 13 04/1291/F - Stone House, St Julians Friars, Shrewsbury

Include the following additional condition:

Hours of opening between 8.00 am and 9.00 pm and the premises to be used for café use only.

Reason: To protect the amenities of nearby residential properties.

Item 14 04/1318/F - 46 Alexandra Avenue, Shrewsbury

The Development Control and Environmental Protection Committee determined that the application be refused for the following reason:

In the opinion of the Local Planning Authority the proposed dwelling is of a design which is out of scale with surrounding properties and introduces a terracing element in the street scene and would overlook nearby dwellings hence contrary to Policy GP1 of the Borough Local Plan.

Members of the Committee determined that the application be refused contrary to Officer advice for the above reasons.

Delegate refusal to the Development Control Manager subject to receipt of further comments from the Shropshire County Council Highways Department


64/04 QUARRY VIEW, KINGSLAND, SHREWSBURY (FORMERLY LAND AT REAR OF 10 LONGDEN ROAD)

Consideration was given to the report of the Development Control Manager in relation to proposed amendments to planning permission 99/308/RM/339/81 to include the insertion of a first floor bedroom on the east side elevation and two retrospectively installed rooflights at Quarry View, Kingsland, Shrewsbury.

RESOLVED:

That the east side elevation bedroom window and 2 velux rooflights on the east roof elevation shown on the amended plan received on the 13th October 2004 be treated as acceptable amendments to planning permission 99/308/RM/339/81.

 

65/04 CONSULTATIONS OF HEAVY GOODS VEHICLE LICENCE APPLICATIONS

Consideration was given to the report by the Development Control Manager outlining the present and future arrangements for consultation with Parish Councils regarding Heavy Goods Vehicle Licence applications.

RESOLVED:

    1. That Parish Councils not able to electronically receive As and Ds or access, be notified of such proposals in their area.

    2. That objections be raised with the Traffic Commissioners to valid objections to As and Ds received within 14 days of their publication, following consultation with Legal Services.

 

66/04 LOCAL AIR QUALITY AND ASSESSMENT AIR QUALITY MANAGEMENT AREAS - DRAFT ACTION PLAN

Consideration was given to a report of the Environmental Health Manager on Local Air Quality and Assessment Air Quality Management Areas - Draft Action Plan. The Principal Environmental Health Officer indicated that the purpose of the draft Air Quality Action Plan was to introduce a wide range of measures required to address Nitrogen Dioxide levels of concern in three Air Quality Management Areas declared by the Council in May 2003. The report advised on the implications of adopting the plan and highlighted the difficulties faced in implementing some elements of the plan. The Portfolio Holder for Air Quality Issues, Councillor Ms Wild, explained that it was an important issue and indicated lots of relatively simple things that could be undertaken to alleviate the problem of pollution. The Principal Environmental Health Officer reported that air quality monitoring would continue to be undertaken at numerous locations throughout the Borough and confirmed that Environmental Health would be continuing to review and assess air quality on a four yearly rolling programme basis to identify any other areas of concern, further measures to be undertaken and progress in implementing the Air Quality Action Plan.

The Chairman thanked the Principal Environmental Health Officer and Ms Jan Cooke of Shropshire County Council for presenting the comprehensive report.

RESOLVED:

a). The Final Draft Air Quality Action Plan be formally adopted and submitted to DEFRA for approval;

b) That, subject to approval by DEFRA, the Air Quality Action Plan be published and made available on the Council's website

c) That the implementation of the measures be commenced in partnership with Shropshire County Council and the other organisations identified in the Air Quality Action Plan;

d) That pollutant monitoring be continued, including the use of the real time mobile air quality monitoring station and that appropriate budgetary provision be continued (and that capital costs be identified for future replacement, if necessary, of the station).

e) That budgetary provision of £10,000 be made for 2005 to cover specialist pollutant modelling work in respect of the Air Quality Action Plan. Further that the next round of review and assessment commences in 2007 and that budgetary provision of £20,000 be made to cover specialist pollutant modelling work.

f) That a further report be submitted to members in respect of the enlarged town centre Air Quality Management Areas, conclusions of the work on PM10 and SO2 and revised Air Quality Action Plan

g) That the Licensing and Safety Committee be asked to examine the Air Quality Action Plan with particular regard to traffic emissions caused by taxis

 

67/04 CYCLE OF MEETINGS

Consideration was given to the report of the Development Control Manager in respect of the cycle of meetings for the Development Control and Environmental Protection Committee.

RESOLVED:

That the cycle of meetings for the Development Control and Environmental Protection Committee be set at 4 weekly intervals following the meeting of Annual Council in May 2005


68/04 PLANNING APPEALS

Consideration was given to appeal decisions by the Planning Inspectorate in respect of a site at The White Horse Public House, Wenlock Road, Shrewsbury Ref 04/0404/ADV and Land at Mansion View, Ford Ref 03/0787/F and 03/0842/LB which had been received by the Development Control Manager.

RESOLVED:

That the decision of the Planning Inspectorate for the appeals regarding a site at The White Horse Public House, Wenlock Road, Shrewsbury and Land at Mansion View, Ford be noted.

 

69/04 EXEMPT MATTERS

RESOLVED:

That under section 100A (4) of the Local Government Act 1972, the public be excluded from the meeting during consideration of the following item on the grounds that it could involve the disclosure of exempt information as defined in Paragraphs 13 and 14 of Part 1 of Schedule 12A of the Act.

70/04 155 SUTTON ROAD, SHREWSBURY

Consideration was given to an exempt report by the Development Control Manager in respect of 155 Sutton Road, Shrewsbury.

RESOLVED:

That the recommendations as detailed in the exempt report of the Development Control Manager be approved.
