74/04 APPLICATIONS FOR DEVELOPMENT

The Development Control Manager submitted a schedule of applications for development with his recommendations detailed thereon. In addition to the objections and representations detailed on the schedule, the Committee also considered further schedules of additional objections/representations received, copies of which are attached to the signed minutes, which were circulated at the meeting.

Members had made visits to the following sites prior to the start of the meeting:

  • Pear Tree Cottage, Great Ness, Shrewsbury;

  • 2 Horsebridge Road, Minsterley, Shrewsbury;

  • Hazelhurst, Montford Bridge, Shrewsbury;

  • Land at Hall Bank, Pontesbury, Shrewsbury;

  • Nags Meadow, Pontesbury, Shrewsbury;

  • St Mary's Court, 21 St Mary's Street, Shrewsbury;

  • 92 London Road, Shrewsbury; and

  • Land to the rear of Maranatha, 100 Belle Vue Road, Shrewsbury.

Councillor Mrs Brennand indicated that in relation to Item 28 - 92 London Road, Shrewsbury she was the local ward member and had been in discussion with local residents against the application. In accordance with paragraphs 8.7 and 8.8 of the Local Protocol for Councillors and Officers dealing with Planning Matters, she made a statement on the application and then left the Chamber and took no part in the consideration of and voting on the application.

Councillor Ms Wild indicated that in relation to Item 3 - Betton Abbots Landfill Site, Betton Abbots, Shrewsbury she was the local ward member and had been in discussion with local residents against the application. In accordance with paragraphs 8.7 and 8.8 of the Local Protocol for Councillors and Officers dealing with Planning Matters, she made a statement on the application and then left the Chamber and took no part in the consideration of and voting on the application.

RESOLVED:

That, subject to the amendments set out below, the recommendations of the Development Control Manager, as contained in the Schedule of Applications (a copy of which is attached to the signed minutes), be approved:

Item 1 04/1503/F - Land at Ebrey Wood, Bings Heath, Astley, Shropshire

Subject to the following additional condition:

Use be restricted to the storage of agriculture including fodder, livestock, horse and tractor and other agricultural produce and equipment with the prior written permission of the Local Planning Authority.

Item 3 04/1602/CM - Betton Abbots Landfill Site, Betton Abbots, Shrewsbury

Subject to the following additional conditions:

That the hours of use be restricted to Monday to Friday, 8.00 am to 5.30 pm and Saturday, 8.00 am to 1.00 pm

All on-site composting being for material spread on the Betton Abbots Landfill Site only

That the operation of the dry recyclables bulking facility continue until January 2006 at the latest and preferably closing as soon as possible.

Reason: In the interests of the amenities of the occupants of nearby residential properties.

Item 6 04/1575/F - Moskoka, Stapleton, Shrewsbury

To amend description of the application to read: 'Erection of a single storey rear extension' and delete and balcony above

Item 7 04/1554/VAR - Land adj Poultry Farm, Ford, Shrewsbury

Delegate approval to the Development Control Manager subject to receipt of further comments from the Highways Agency

Item 9 04/1490/F - Pear Tree Cottage, Great Ness, Shrewsbury

Include the following additional condition:

The proposed french doors in the lounge and western end of the converted building shall be non opening and permanently retained as such unless otherwise agreed in writing with the Local Planning Authority.

Reason: To ensure the safety of future occupiers of Pear Tree Cottage.

Item 10 04/1544/F - 2 Horsebridge Road, Minsterley, Shrewsbury

The Development Control Manager referred to a very late letter that had not been included in the Schedule of late letters circulated at the meeting which was received from the Highways Authority. As a result of which, the application was being recommended for refusal not approval. Members of the Development Control and Environmental Protection Committee determined that the application be refused for the following reason:

In the opinion of the Local Planning Authority, visibility from the proposed combined access is restricted in a southerly direction along Horsebridge Road by the adjoining property boundary and horizontal alignment of the carriageway. It is considered therefore that the formation and use of the combined access is likely to lead to conditions detrimental to the free flow and safe movement of traffic on Horsebridge Road and would be contrary to Policy P15 of the Shropshire and Telford and Wrekin Joint Structure Plan and Policy GP1 of the Borough Local Plan Policy.

Item 14 04/1486/F - Nags Meadow, Pontesbury, Shrewsbury

Members of the Development Control and Environmental Protection Committee determined that the application be refused for the following reason:

In the opinion of the Local Planning Authority, it is considered that the proposal would be detrimental to the character and appearance of this area due to cramped and overcrowded appearance and hence contrary to Policy HS3(ii) of the Borough Local Plan.

Members of the Committee determined that the application be refused contrary to Officer advice for the above reason.

Item 16 04/1414/F - St Mary's Court, 21 St Mary's Street, Shrewsbury

Members of the Development Control and Environmental Protection Committee determined that the application be refused for the following reason:

In the opinion of the Local Planning Authority, it is considered that the erection of an additional floor on this building would be dominant and overbearing in the streetscene and neither preserve nor enhance this part of the town centre conservation area and be detrimental to Shrewsbury's historic skyline. Therefore, the proposal is contrary to policies HE8 and HE12 of the Borough Local Plan.

Members of the Committee determined that the application be refused contrary to Officer advice for the above reason.

Item 23 04/1576/F - British Telecom, Town Walls, Shrewsbury

Approval delegated to the Development Control Manager subject to the receipt of scale plans.

Item 25 04/1586/DDM - Frankwell Quay, Shrewsbury

Include the following additional condition:

All trees not required to be removed to allow the proposed development shall be retained and such trees shall be protected in accordance with details to be submitted to and agreed in writing with the Local Planning Authority.

Reason: To safeguard the amenities of the locality and to protect the natural features of importance in the appearance of the development.

Item 26 04/1588/DDM - Frankwell Quay, Shrewsbury

Include the following additional condition:

All trees not required to be removed to allow the proposed development shall be retained and such trees shall be protected in accordance with details to be submitted to and agreed in writing with the Local Planning Authority.

Reason: To safeguard the amenities of the locality and to protect the natural features of importance in the appearance of the development.

Item 28 04/1605/VAR - 92 London Road, Shrewsbury

Members of the Development Control and Environmental Protection Committee determined that the application be refused for the following reason:

During construction of the dwelling all construction vehicles shall enter the site via a temporary access route through the garden of 92 London Road and shall not use Armoury Gardens.

Reason: In the interests of amenity of the occupiers of dwellings in Armoury Gardens and due to the restricted nature of that road.

Item 32 04/1535/F - Gains Lodge East, Gains Avenue, Bicton Heath, Shrewsbury

Application withdrawn by the applicant.

 

75/04 SERVICE IMPROVEMENTS: ELECTRONIC NOTIFICATION OF PLANNING APPLICATIONS

Consideration was given to a report of the Development Control Manager in respect of proposals to allow Councillors, Parish Councils and individuals a means to be advised electronically of local planning applications. He further reported that the Planning OnLine website had been placed second out of all English Councils following the recent Pendleton Survey.

RESOLVED:

That the report of the Development Control Manager be noted.

 

76/04 PLANNING APPEALS

Consideration was given to appeal decisions by the Planning Inspectorate in respect of 17 New College Road, Shrewsbury Ref 04/0203/F which had been received by the Development Control Manager.

RESOLVED:

That the decision of the Planning Inspectorate for the appeal in respect of 17 New College Road, Shrewsbury be noted.
