1. MINUTES - 11th January 2005
Recommendation:
That the Minutes of the meeting of the Development Control and Environmental Protection Committee held on 11th January 2005 be confirmed as a correct record and be signed by the Chairman.

4. APPLICATIONS FOR DEVELOPMENT
To consider the schedule of applications for development submitted by the Development Control Manager.
The Chairman will propose that with regard to applications on the schedule of applications for development submitted by the Development Control Manager on which there is no debate, the recommendations of the Officers be deemed to have been accepted without any modifications.
5. TREE PRESERVATION ORDERS
To consider the report of the Planning Policy Officer.
Recommendations
(a) That the variation to the Shrewsbury & Atcham Borough Council (Balls Coppice, Upper Battlefield) Tree Preservation Order 2004, varied 2004 be confirmed without modification, and;
(b) That the Shrewsbury & Atcham Borough Council (North Condover) Tree Preservation Order 2004 be confirmed; subject to amendments to the TPO to include numbering for G1, to the location given for T2 and G2 and to the locations and descriptions for G4 and G5. Also the adding of an additional 10 no. trees to G4 and the adding of an additional 1no. tree to G5
6. PLANNING APPEALSThe following decisions of the Planning Inspectorate have been received by the Council regarding appeals against a decision to refuse to grant planning permission:
Grounds of Blythe Cottage, Shelton Lane, The Mount, Shrewsbury
- Erection of a detached dwelling with associated groundworks Ref: 04/0002/FDecision:
Appeal dismissed 22nd December 2004Summary:
The key issues in this case were the effect of the proposal on the character and appearance of the surrounding area and secondly the adequacy of the amenity space that could be provided for the existing and proposed dwelling. On the first issue the plot would be close to the road and the dwelling would be large and prominent and not appear as an extension of Mountwood Park. The height and mass of the dwelling would also make it appear unduly prominent and intrusive in the streetscene. The combination of size, siting and level resulted in the building detracting from the character of the locality. With regard to the amenity space issue the Inspector considered that the formation of the 2 terraces in the existing garden would result in more amenity space for the existing house and the new garden was comparable to those on the nearby estate.Land at 11 St James Road, Shrewsbury
- Erection of a detached dwelling and formation of new access. Ref 04/0161/F.Decision:
Appeal dismissed 6th January 2005Summary:
The key issue was the impact of the dwelling on character and appearance of the locality. The narrow, tapering plot would result in a cramped development, not in keeping with the prevailing design and plot sizes on the eastern side of the road. The development would unacceptably harm the character and appearance of the area on these grounds.Site at The Gables, Kendricks Bank, Bayston Hill, Shrewsbury
- Variation of condition 4 of the permission for the erection of a garage, to allow the formation of a granny flat. Ref 03/1499/FDecision:
Appeal dismissed 12th January 2005Summary:
The key issue was the effect of the proposed annex on the living conditions of the occupier of nearby properties. In respect of loss of privacy, noise and general disturbance, the Inspector considered that the location of the building was such that it was not an appropriate location for an annex as it was on the other side of the access drive. The proximity to neighbouring properties was such that the more intensive use would cause disturbance to residents due to the domestic activities which would occur. The rooflights would result in overlooking and the loss of the garage would further exacerbate the potential disruption to neighbours.Site at 8 Percival Close, Shrewsbury -
Erection of first floor extension above garage and utility. Ref 04/0175/FDecision:
Appeal allowed 17th January 2005Summary:
The key issue in this case was the impact of the proposal on the residential amenity and outlook of the neighbouring properties. The higher floor level of the property facing the extension would result in no further detriment compared to the existing flat roof and indeed the pitched roof would tidy up the building and outlook. The development would also help to screen some of the gardens of properties nearby.
