Item 5: 04/1668/F - Land between Darwin & Pride Hill Shopping Centre, Raven Meadows
To amend the Planning / Environmental Considerations in the Officers' report as detailed in the Schedule of Applications to include an additional condition that the new nightclub should only become operative when the existing nightclub ceases operation, and that this not be subject to the Section 106 Agreement.
Minute Number 08/05 (Item 6) condition amended to read:
Prior to the commencement of the development full details of the proposed road widening to a minimum width of 4.1 metres shall be submitted for the prior written approval of the Local Planning Authority. The widened roadway shall be constructed to base course level prior to the commencement of any below ground works on the site and fully completed prior to the occupation of the last dwelling.

11/05 LOCAL AIR QUALITY REVIEW AND ASSESSMENT
Consideration was given to a report of the Environmental Health Manager in respect of proposals to enlarge an Air Quality Management area for the town centre.
RESOLVED:
- That an enlarged Air Quality Management Area be formally declared by Order and the existing Action Plan be subsequently revised. The consequences of this could include changes to planning policy, constraints on development, pedestrianisation, traffic calming and re-routing and compulsory purchase.
- That an Air Quality Strategy be developed.
- That the Report on the Detailed Assessment of PM10 at Bayston Hill be formally accepted and published on the Council's website. Further, that a report be submitted to members at a future meeting on SO2 from Ironbridge Power Station subject to its approval by DEFRA.
- That as no budgetary provision had been agreed, Cabinet and Council be recommended to make budgetary provision of £10,000 for 2005/06 to cover specialist pollutant modelling work in respect of further assessment work.

The Development Control Manager submitted a schedule of applications for development with his recommendations detailed thereon. In addition to the objections and representations detailed on the schedule, the Committee also considered further schedules of additional objections/representations received, copies of which are attached to the signed minutes, which were circulated at the meeting.

RESOLVED:
That, subject to the amendments set out below, the recommendations of the Development Control Manager, as contained in the Schedule of Applications (a copy of which is attached to the signed minutes), be approved:
Item 3: 05/0046/F - The Old Goods Yard (Land at), Hanwood, Shrewsbury
Members of the Development Control and Environmental Protection Committee determined that the application be refused for the following reason:
In the opinion of the Local Planning Authority, it is considered that the site is served by means of a private drive which is considered substandard in width and junction layout with the A488 to serve as a means of access to the proposed development. As a result it is considered that the intensification in the use of the access onto the A488 as a result of the proposed development would be likely to lead to conditions detrimental to highway safety. Therefore, the proposal is contrary to the Joint Structure Plan Policy P15 and Borough Local Plan Policies GP1 and HS3.
Members of the Committee determined that the application be refused contrary to Officer advice for the above reason.
Item 7: 04/1849/F - Uniq, Minsterley, Shrewsbury
Application deferred pending the receipt of a full and substantive response from Shropshire County Council Highways Engineers to the Local Traffic Impact Assessment.
Item 11: 04/1828/F - Land adjacent 1 Lindley Street, Shrewsbury
Application deferred to enable Members of the Development Control and Environmental Protection Committee to visit the site.
Item 12: 05/0003/O - 70 Sundorne Road (land to rear of), Shrewsbury
Members of the Development Control and Environmental Protection Committee determined that the application be refused for the following reason:
In the opinion of the Local Planning Authority, it is considered that the proposed development of four dwellings in the manner proposed would lead to both an unacceptable over development of the site and a detrimental loss of privacy to neighbouring properties. Therefore, the proposal is contrary to policy P15 of the Joint Structure Plan and policies GP1 and HS2 of the Borough Local Plan.
Members of the Committee determined that the application be refused contrary to Officer advice for the above reason.
Item 18: 05/0098/F - Land to the north of 1 Willow Cottages, Hereford Road, Shrewsbury
Amend Local Community Comments to read 5 (five) letters of objection received.
Item 22: 04/1836/VAR - Stone House Farm, Ruckley, Acton Burnell, Shrewsbury
Application withdrawn by the applicant.
Item 24: 04/1846/F - Pontoon, Victoria Quay, Shrewsbury
Members of the Development Control and Environmental Protection Committee determined that the application be approved subject to standard conditions including those requested by the Environment Agency.
Members of the Committee determined that the application be approved contrary to Officer advice for the following reason:
It is not considered that the structure would cause any significant problems due to its modern design, its fixed moorings and would represent a positive contribution to river usage.
13/05 SECTION 106 LEGAL AGREEMENTS AND PLANNING REPORT
Consideration was given to a report of the Development Control Manager in respect of the future use of planning conditions to provide elements which would normally be subject to a Section 106 legal agreement prior to the issuing of a planning permission.
RESOLVED:
- That the Council use planning conditions to secure the provision of affordable housing and highways/ environmental works in accordance with a scheme to be agreed with the Council before development commenced. Such conditions only to be used where the Council had received a letter from the developer agreeing to the use of such conditions instead of a S106 agreement
- That the payment of monies by developers continue to be secured through the use of S106 agreements.
14/05 PLOT 2, KNIGHTS WAY, BATTLEFIELD ENTERPRISE PARK, SHREWSBURY
Consideration was given to a report of the Development Control Manager in relation to proposed amendments to planning permission 04/0922/F to increase the width of Unit A1 from 22.6m (as approved) to 36.4 m at Plot 2, Knights Way, Battlefield Enterprise Park, Shrewsbury.
RESOLVED:
That the amended plans be accepted and approved as an amendment to the current planning permission reference 04/0922/F.
15/05 PLANNING APPEALS
Consideration was given to appeal decisions by the Planning Inspectorate in respect of the following sites which had been received by the Development Control Manager:
- Site at 32 Queen Street, Shrewsbury 04/0223/F - Appeal allowed 3rd February 2005
- The Granary, Church Farm, Buildwas 03/1649/F - Appeal allowed 24th January 2005
RESOLVED:
That the decisions for the following appeals be noted:
(a) Site at 32 Queen Street, Shrewsbury 04/0223/F - Appeal allowed 3rd February 2005; and
(b) The Granary, Church Farm, Buildwas 03/1649/F - Appeal allowed 24th January 2005.
