16/05 DEVELOPMENT CONTROL MANAGER

The Vice Chairman reported that Mr Fenwick (Development Control Manager) was due to retire on the 31st March 2005. The Committee presented Mr Fenwick with a token of their appreciation and agreed that thanks be formally placed on record for the service and hard work he had given during his service with the Council and that he be wished well in his forthcoming retirement.

 

17/05 APPLICATIONS FOR DEVELOPMENT

The Development Control Manager submitted a schedule of applications for development with his recommendations detailed thereon. In addition to the objections and representations detailed on the schedule, the Committee also considered further schedules of additional objections/representations received, copies of which are attached to the signed minutes, which were circulated at the meeting.

Members had made visits to the following sites prior to the start of the meeting:

Following advice provided by the Senior Solicitor in relation to Item 19 - Land at Meole Brace roundabout, A5112/B4380 junction, Meole Brace, Shrewsbury, Councillor Owen indicated that he did not have a personal interest but withdrew from the Chamber and took no part in the voting on the application as his wife, Councillor Mrs Owen spoke against the application.

RESOLVED:

That, subject to the amendments set out below, the recommendations of the Development Control Manager, as contained in the Schedule of Applications (a copy of which is attached to the signed minutes), be approved:

Item 1: 05/0111/F - 8 Pulley Lane, Bayston Hill, Shrewsbury

The Development Control Manager reported that Councillor Clarke had objected to the application.

Members of the Development Control and Environmental Protection Committee determined that the application be refused for the following reason:

In the opinion of the Local Planning Authority, it is considered that the proposal would result in an unneighbourly form of development in that it would lead to overlooking and would be dominant and overbearing to neighbouring properties which the Local Planning Authority considers would be detrimental to the amenities which the occupiers of the adjoining property could reasonably expect to enjoy and is contrary to Policy GP4 of the Borough Local Plan.

Members of the Committee determined that the application be refused contrary to Officer advice for the above reason.

Item 4: 05/0054/F - Land adjacent Sunnyfields, Church Lane, Bicton, Shrewsbury

Amend conditions to read 'maximum opening of window be 200 mm'.

Item 7: 05/0037 - Land adj Bank House, Main Road, Hanwood, Shrewsbury

Delegate approval to the Development Control Manager subject to the receipt of amended plans.

Item 12: 05/0023/F - Newnham Farm. Yockleton, Shrewsbury

Members of the Development Control and Environmental Protection Committee determined that the application be refused for the following reason:

In the opinion of the Local Planning Authority, it is considered that the proposal would be visually detrimental and harmful to the character of the open area of countryside, and hence is contrary to Policy LNC3 of the Borough Local Plan.

Members of the Committee determined that the application be refused contrary to Officer advice for the above reason.

Item 20: 05/0113/F - The Bricklayers Arms, Copthorne Road, Shrewsbury

Amend description to read 'Erection of a single storey rear extension and extraction duct'.

Members of the Development Control and Environmental Protection Committee determined that the application be refused for the following reason:

In the opinion of the Local Planning Authority, it is considered that the proposed ducting would be obtrusive and visually detrimental in this location both to passers-by and local residents, and is contrary to Policy S5 of the Borough Local Plan. Furthermore, the submission does not include any details of odour abatement and hence is also contrary to the above policy.

Members of the Committee determined that the application be refused contrary to Officer advice for the above reason.

Item 24: 05/0174/F - Gains Lodge East, Gains Avenue, Bicton Heath, Shrewsbury

Amend Local Community Comments to read 5 (five) letters of objection received.

Item 28: 05/0140/F - 39 Linley Avenue, Pontesbury, Shrewsbury

Members of the Development Control and Environmental Protection Committee determined that the application be approved subject to appropriate conditions.

Members of the Committee determined that the application be approved contrary to Officer advice for the following reason:

That the application is of an acceptable standard in respect of design and scale and fits on the site.

Item 29: 05/0090/F - 45 Torrin Drive, Shrewsbury

Amend Local Community Comments to read 7 (seven) letters of objection received and 5 letters highlighting concern.

 

17/05 ERECTION OF A TWO STOREY FLOATING RESTAURANT, MOORING, PONTOONS AND ASSOCIATED RAMPED ACCESS, PONTOON, VICTORIA QUAY, SHREWSBURY

Consideration was given to a report of the Development Control Manager in respect of the planning permission granted on the 22nd February 2005 for the erection of a two storey floating restaurant mooring, pontoons and associated ramped access, pontoon at Victoria Quay, application reference 04/1846/F.

RESOLVED:

That approval for the application 04/1846/F be delegated to the Development Control Manager subject to the receipt of revised plans showing the structure / boat being moved to 11 metres away from the river gauge at the Welsh Bride and subject to appropriate conditions.

 

18/05 CONSULTATION FROM BRITISH TELECOM ON PAYPHONES IN SHREWSBURY AND ATCHAM DISTRICT

Consideration was given to a report of the Development Control Manager detailing the response received from British Telecom further to the formal consultation on the proposed removal of 16 payphones which was considered on the 27th July 2004.

RESOLVED:

That in light of BT's further comments and recognising that payphones cannot be retained solely for emergency use, that no objection be raised to the removal of the Albrighton payphone.

 

19/05 PLANNING APPEALS

Consideration was given to appeal decisions by the Planning Inspectorate in respect of the following sites which had been received by the Development Control Manager:

  1. Site at Ebrey Wood, Astley, near Shrewsbury 04/0498/F - Appeal dismissed 14th February 2005

  2. Land at Wroxeter Vineyard, Wroxeter, Shrewsbury 04/0309/O - Appeal dismissed 15th February 2005

RESOLVED:

That the decisions for the above appeals be noted.
