26/05 APPOINTMENT OF CHAIRMAN
RESOLVED:

The Planning Services Manager submitted a schedule of applications for development with his recommendations detailed thereon. In addition to the objections and representations detailed on the schedule, the Committee also considered further schedules of additional objections/representations received, copies of which are attached to the signed minutes, which were circulated at the meeting.
Councillor Cooke indicated that in relation to Item 33 - Land adjacent Wilcot Manor, Wilcot Nesscliffe, Shrewsbury he did not have a personal interest but was opposed to the application. In accordance with paragraphs 8.7 and 8.8 of the Local Protocol for Councillors and Officers dealing with Planning Matters, he made a statement on the application and then left the Council Chamber and took no part in the consideration of and voting on the application.

RESOLVED:
That, subject to the amendments set out below, the recommendations of the Planning Services Manager, as contained in the Schedule of Applications (a copy of which is attached to the signed minutes), be approved:
Item 8: 05/0441/O - Old School House, Longden, Shrewsbury
Amend description to read 'Outline application for the erection of a dwelling and detached garage to include access'.
Item 14: 05/0475/F - 1 Ashford Park, Pontesbury, Shrewsbury
Members of the Development Control and Environmental Protection Committee determined that the application be refused for the following reason:
In the opinion of the Local Planning Authority, it is considered that the proposed gabled roof would have an overbearing and unneighbourly impact on the residential amenity of the neighbouring property hence contrary to the Borough Local Plan Policy GP1.
Members of the Committee determined that the application be refused contrary to Officer advice for the above reason.
Item 21 05/0511/F - Nettles Lane, Shrewsbury
The Head of Development Control confirmed that the Flood Risk Assessment had now been submitted and hence to delete the reference 'that the application is delegated to the Planning Services Manager on receipt of a satisfactory assessment' from the Planning / Environmental Considerations from the Officers' report.
Item 22 05/0528/O - Land to rear of 12 Port Hill Gardens, Shrewsbury
Members of the Development Control and Environmental Protection Committee determined that the application be refused for the following reason:
In the opinion of the Local Planning Authority, it is considered that the erection of a dwelling on this plot would be detrimental to the visual character and appearance of the locality; have a harmful impact on the trees within the site and the living conditions of the residents of the new dwelling would be detrimentally affected by the trees on the plot contrary to the Joint Structure Plan Policy P15 and the Borough Local Plan Policy GP1.
Members of the Committee determined that the application be refused contrary to Officer advice for the above reason.
Item 24 05/0561/F - Newport House and 19 Dogpole, Shrewsbury
Include the following informative:
The applicant is advised to contact the Shropshire County Council Rights of Way Officer to check that no public rights across the land in front of 19 Dogpole are being infringed.
Item 32 05/0319/F - Golding Hall, Golding, Pitchford, Shrewsbury
Members of the Development Control and Environmental Protection Committee determined that the application be approved subject to standard conditions.
Members of the Committee determined that the application be approved contrary to Officer advice for the following reason:
That the existing planting coupled with a reduction in ground level for car park would make the impact of the proposed car park acceptable and the proposed scheme would not be detrimental to the character or appearance of the listed buildings.
Item 36 05/0512/O - Land adjacent to Greenfields, Vennington, Westbury
Members of the Development Control and Environmental Protection Committee recommended that the application be approved due to the employment opportunities afforded by the application and taking account of the importance of bus services in the rural areas. The personal medical reasons submitted in support of the application were also acknowledged.
The Head of Development Control considered that this was a significant departure from the Development Plan, and in accordance with the procedure adopted by Council, the matter would be referred to the Planning Committee for determination after advertising as a Formal Departure.
29/05 LAND AT SUTTON LANE, SHREWSBURY
Consideration was given to a report of the Planning Services Manager in respect of proposed amendments to the planning permission granted on the 27th July 2004 reference 04/0389/F.
RESOLVED:
That the amended house type of 18 x 2 bed apartments; 6 x 2 bed houses; 6 x 3 bed houses and 8 x 4 bed houses be treated as acceptable working amendments to planning permission 04/0389/F and the S106 be amended accordingly.
30/05 ERECTION OF A SINGLE ATTACHED GARAGE, PLOT 1, MANOR PARK, MAIN ROAD, PONTESBURY
Consideration was given to a report of the Planning Services Manager in respect of proposed amendments to the planning permission 05/0248/F granted on the 6th April 2005.
RESOLVED:
That the drawings received on the 13th April 2005 be accepted as an amendment to the planning permission 05/0248/F approved on the 6th April 2005.
31/05 LAND AT THE OAKS, NESSCLIFFE
Councillor Cooke indicated that in relation to this item he did not have a personal interest but was opposed to the application. In accordance with paragraphs 8.7 and 8.8 of the Local Protocol for Councillors and Officers dealing with Planning Matters, he made a statement on the application and then left the Council Chamber and took no part in the consideration of and voting on the application.
Councillor Price indicated that in relation to this item he did not have a personal interest but had recently attended a meeting with the developers as Portfolio Holder. In accordance with paragraphs 8.7 and 8.8 of the Local Protocol for Councillors and Officers dealing with Planning Matters, he made a statement on the application and then left the Council Chamber and took no part in the consideration of and voting on the application.
Consideration was given to a report of the Planning Services Manager in respect of an objection from a nearby property in respect of overlooking and loss of privacy, size of the properties, floor levels and suggesting the Officers' report was misleading and unrepresentative in respect of the erection of two detached dwellings at The Oaks, Nesscliffe planning reference 03/1256/F.
RESOLVED:
That the amended fencing proposed for the patio and boundary fence be approved for Land at The Oaks, Nesscliffe planning reference 03/1256/F as set out on drawing HL1001 Revision Y received on the 19th May 2005.
32/05 PLANNING APPEALS
Consideration was given to appeal decisions by the Planning Inspectorate in respect of the following sites which had been received by the Planning Services Manager:
- Woodside, Fords Heath, Shrewsbury Ref 04/1050/F - Appeal allowed 21st April 2005
- Wildes Plant Hire, Station Road, Dorrington Ref: 04/774/F - Appeal dismissed 21st April 2005.
- 29 Highfields, Shrewsbury - Ref 04/0883/TPO - Appeal part allowed, part dismissed 29th April 2005
- Land at the junction of Battlefield Road and Featherbed Lane, Shrewsbury - Ref 04/1073/F - Appeal Dismissed 11th May 2005
