39/05 APPLICATIONS FOR DEVELOPMENT

The Planning Services Manager submitted a schedule of applications for development with his recommendations detailed thereon. In addition to the objections and representations detailed on the schedule, the Committee also considered further schedules of additional objections/representations received, copies of which are attached to the signed minutes, which were circulated at the meeting.

Members had made visits to the following sites prior to the start of the meeting:

  • Baxter House (land adjacent), Eaton Constantine, Shrewsbury;

  • 82 Copthorne Road, Shrewsbury;

  • Welti Tennis and Leisure, Sundorne Road, Shrewsbury;

  • Garden Cottage, Withington, Shrewsbury;

  • Holly Bush Cottage, Adcote Drive, Little Ness, Shrewsbury;

RESOLVED:

That, subject to the amendments set out below, the recommendations of the Planning Services Manager, as contained in the Schedule of Applications (a copy of which is attached to the signed minutes), be approved:

Item 3: 05/0782/VAR – 4 New Street, Ford, Shrewsbury

Include the following additional condition:-

The car parking area shown on the approved plan should be made available and hard surfaced, in a material to be agreed in writing by the Local Planning Authority prior to the occupation of the extension, and permanently retained.

Reason: In order to ensure adequate on site parking in the interest of safety on the adjacent access track.

Item 5: 05/0850/F – Baxter House (land adjacent), Eaton Constantine, Shrewsbury

The Development Control and Environmental Protection Committee determined that the application be refused for the following reason:

In the opinion of the Local Planning Authority, it was considered that the size, design and visual impact of the dwellings would be detrimental to the setting of the nearby listed building and unduly prominent in the locality. The application was contrary to the Joint Structure Plan policies P15 and P24 and Borough Local Plan policies GP1, HE7 and LNC3.

Members of the Committee determined that the application be refused contrary to Officers advice for the above reason.

Item 6: 05/0743/O – The Farriers, Annscroft, Shrewsbury

The Development Control and Environmental Protection Committee determined that authority be delegated to the Head of Development Control to approve the application subject to appropriate conditions to include a landscaping condition TO3 on the permission when released and upon the expiry of the application being advertised as a departure, subject to no adverse comments being received.

Item 7: 05/0236/F – 30 Havelock Road, Shrewsbury

The Development Control and Environmental Protection Committee determined that the application be refused for the following reasons:

In the opinion of the Local Planning Authority, it is considered that the proposed dwelling by virtue of its design and appearance, would be an alien feature in the locality and would not preserve or enhance the character and appearance of the conservation area. The application was contrary to Joint Structure Plan policy P24 and Borough Local Plan policy HE8.

The construction of the dwelling and the new access would have a detrimental impact on the existing trees within and adjacent to the site and landscaping and have a detrimental impact on the longer term life of the trees and vegetation due to the cramped nature of the development. The application was contrary to Joint Structure Plan policy P15 and the Borough Local Plan policies GP1 and LNC10.

The new access located on a narrow section of the highway with minimal visibility would result in danger to both pedestrians and vehicular traffic. The application was contrary to Joint Structure Plan policy P15 and Borough Local Plan policy GP1.

Members of the Committee determined that the application be refused contrary to Officer advice for the above reason.

Item 21: 05/0763/F – Long Jacks Cottage, Holyhead Road, Nesscliffe, Shrewsbury

The Development Control and Environmental Protection Committee determined that the application be approved subject to standard and additional conditions:-

Prior to the commencement of any development above ground level a 1m sample panel of stonework shall be constructed for approved and the agreed external finish used to face the external elevation.

Reason: In order to ensure a satisfactory stonework finish to the extension.

The roof material shall match in profile, colour and texture of the existing roof material.

Reason: In order to ensure a satisfactory appearance to the extension.

The Committee determined that the application be approved contrary to Officer advice for the following reason:

The existence of an extant planning permission for a single storey conservatory in a similar location to the proposal would mean that the new extension matching stone would have an improved visual impact on the character and appearance of the dwelling and would not be out of scale or be harmful to the locality.

Item 25: 05/0832/F – Unit 5A, March Way, Battlefield Enterprise Park, Shrewsbury

The Development Control and Environmental Protection Committee determined that the application be approved subject to standard and additional conditions:-

The premises shall not be open between the hours of 23.00 and 11.00 on any day without the written approval of the Local Planning Authority.

Reason: In order to control late night activity at the premises.

The premises shall only be used as a snooker club and for no other purpose.

Reason: In order to control the activity at the site.

The open areas of the site shall be kept free for car parking spaces for staff and visitors at all times.

Reason: In order to ensure adequate on site car parking facilities.

The Committee determined that the application be approved contrary to Officer advice for the following reason:

In the light of the nett gain in protected employment floor space as a result of the change of use and the nature of the activities it is considered that this site was an appropriate one for this location and would not be detrimental to the locality.

 

40/05 42 OLD COLEHAM, SHREWSBURY

Consideration was given to a report of the Planning Services Manager in respect of proposed amendments to planning permission 05/0384/F granted on the 25th May 2005.

RESOLVED:

That planning permission reference 05/0384/F approved on 25th May 2005 be amended to allow the use of the building as a sports hall for the after school club between the hours of 9.00 a.m. and 6.00 p.m. Monday to Friday during school holidays, and that the building be allowed to accommodate up to 30 children.

 

41/05 LAND BETWEEN DARWIN AND PRIDE HILL SHOPPING CENTRES

Consideration was given to a report of the Planning Services Manager in respect of proposed amendments to planning permission 04/1668/F granted on 1st February 2005.

RESOLVED:

  1. That the amendments shown on the amended plans be accepted subject to (b) and (c) below.

  2. That additional conditions be added to include the windows overlooking the town wall to be kept free of obstructions and merchandise and revised archaeology.

  3. That the S106 agreement be amended so that the Park and Ride contributions will be for £500,000 over 5 years (instead of £300,000 over 3 years).

 

42/05 PLANNING APPEALS

Consideration was given to appeal decisions by the Planning Inspectorate in respect of the following sites which had been received by the Planning Services Manager:

  1. Land between Green Hedges and Appleby, Cross Lane, Ford Ref: 04/0720/O – Appeal dismissed 23rd March 2005;

  2. Walford Heath Nurseries, Walford Heath Ref: 04/1259/O – Appeal dismissed 28th June 2005;

  3. 48 Porthill Gardens, Shrewsbury Ref: 04/1526/VAR – Appeal dismissed 20th June 2005;

  4. Netley Old Hall, Dorrington Ref: 04/0179/ENF – Appeal allowed 10th June 2005;

  5. Former Garage Site, Walford Heath Ref: 04/0718/F – Appeal allowed 22nd June 2005;

  6. Land at 1 Red Barn Lane, Shrewsbury Ref: 05/0123/F – Appeal allowed 6th July 2005; and

  7. Cruckmeole Brickyard, Hanwood, Shrewsbury Ref: 04/1774/F – Appeal dismissed 6th July 2005.

RESOLVED:

That the decisions for the above appeals be noted.
