43/05 TREE PRESERVATION ORDERS

Consideration was given to a report of the Planning Services Manager in respect of Tree Preservation Orders.

RESOLVED:

That the following orders be confirmed without modification:

a.   Shrewsbury & Atcham Borough Council (Land at or adjacent to Yew Tree Lodge, Condover) Tree Preservation Order 2005;

b.   Shrewsbury & Atcham Borough Council (Land at or adjacent to Rylands, Shrewsbury) Tree Preservation Order 2005; and

That the following order be confirmed with modification:

c.   Shrewsbury & Atcham Borough Council (Land at or adjacent to Main Road, David Avenue, Chapel Street, Pontesbury) Tree Preservation Order 2005 subject to amendments to include the removal of T5, T14 and G4 from the Order.

 

44/05 APPLICATIONS FOR DEVELOPMENT

The Planning Services Manager submitted a schedule of applications for development with his recommendations detailed thereon. In addition to the objections and representations detailed on the schedule, the Committee also considered further schedules of additional objections/representations received, copies of which are attached to the signed minutes, which were circulated at the meeting.

Members had made visits to the following sites prior to the start of the meeting:

RESOLVED:

That, subject to the amendments set out below, the recommendations of the Planning Services Manager, as contained in the Schedule of Applications (a copy of which is attached to the signed minutes), be approved:

 

Item 1: 05/0462/F – Dobbies Garden World, Bayston Hill Nursery, Shrewsbury

Include the following additional condition:-

The extension would only be used to retail gardening related products and no others, unless agreed in writing with the Local Planning Authority.

Reason: In order to ensure that the development does not impact on the vitality and viability of Shrewsbury Town Centre and other neighbourhood centres.

 

Item 6: 05/0717/F - Holt Preen Manor, Plaish, Church Stretton, Shropshire

The Development Control and Environmental Protection Committee determined that authority be delegated to the Head of Development Control after the 25th August 2005.

 

Item 10: 05/0723/F – Kinton Business Park, Kinton, Nesscliffe, Shrewsbury

The Development Control and Environmental Protection Committee determined that authority be delegated to the Head of Development Control to approve, to enable the Parish Council to consider the proposal and forward their comments, subject to them raising no issues that haven’t already been considered by Members.

 

Item 15: 05/0699/F – Land to the rear of 5a Roman Road, Shrewsbury

Members of the Development Control and Environmental Protection Committee determined that the application be refused for the following reason:

In the opinion of the Local Planning Authority, it was considered that the proposed garage, by virtue of it’s location, scale and massing was out of keeping with the character and appearance of the Shrewsbury Town Centre conservation area and was contrary to Joint Structure Plan Policy P15 and Borough Local Plan policy GP1 and HE8.

 

Item 16: 05/0837/F – Land at the junction of Harlescott Lane and Whitchurch Road, Shrewsbury

Members of the Development Control and Environmental Protection Committee determined that the application be refused for the following reason:

    1. In the opinion of the Local Planning Authority, it is considered that the design and appearance of the proposal in this prominent roadside location would be detrimental to the character and appearance of the area and was contrary to the Joint Structure Plan policy P15 and Borough Local Plan policy GP1; and
    2. The proposed access design and its relationship to the adjacent high way would create unacceptable delays to traffic exiting from the access and turning right to the detriment of highway safety to road users and pedestrians and was contrary to Joint Structure Plan policy P15 and Borough Local Plan policy GP1.

 

Item 20: 05/0900/F – High Park Farm, All Stretton, Church Stretton

Application withdrawn.

 

Item 21: 05/0980/F – Hillcrest Manor Nursing Home, Reabrook, Minsterley

The Development Control and Environmental Protection Committee determined that the application be approved contrary to Officers advice for the following reason:

Z102…"the need for the development to provide a greater range of accommodation for elderly residents outweighed the visual impact of the extension on the existing building".

Include the following additional conditions and informatives:

GO1; G10I (plans received 7th July 2005); M02, TO3 and Z100.

 

Item 22: 05/0668/F – Land to the rear of the T.A. Centre, off Montgomery Way, Sundorne, Shrewsbury

Application withdrawn.

 

Item 23: 05/0915/F – Unit 12, Castle Business Park, Shrewsbury

The Development Control and Environmental Protection Committee determined that the application be approved contrary to Officers advice for the following reasons:

Z16; Z100; Z102I;…"the community benefits to be gained from the development outweighed the loss of employment floor space within the existing building".

Include the following additional conditions and informatives:

GO1; G101 (plans received 24th June 2005); The premises shall be used for martial arts purposes only within class D2 of the Town and Country Planning (use classes) Order 1987 as amended and for no other purpose; Z16; Z100.

Reason:

In order to control the type of development and its impact on the surrounding area.

The premises shall not be open for use between 21:00 hours and 08:00 hours on any day unless otherwise agreed in writing by the Local Planning Authority.

Reason:

In order to control the hours of operation in the interest of amenity.

 

45/05 B.T. PROPOSALS TO RE-ALIGN PROVISIONS IN SHREWSBURY AREA

Consideration was given to a report of the Planning Services Manager in respect of British Telecom proposals to re-align provisions in the Shrewsbury Area.

Councillor Bebb indicated that he did not have a personal interest by had expressed an opinion prior to the meeting stating that he was opposed to the removal or conversion of boxes in the Pontesbury, Yockleton and Hanwood area.

He stated that a revised recommendation had been forwarded to the Area Planning Officer but this had not been noted in the Officer’s recommendation.

The Head of Development Control stated that Councillors could make comment to him on the consultation prior to the dead line date for the consultation paper.

RESOLVED:

That no objections be raised in principle to either the removal of the boxes or conversion to card use only, but members views on individual boxes be forwarded prior to 23rd August 2005.

 

46/05 PLANNING APPEALS

Consideration was given to appeal decisions by the Planning Inspectorate in respect of the following sites which had been received by the Planning Services Manager:

  1. Land at 6 Thornhill Road, Shrewsbury Ref: 04/1777/O – Appeal dismissed 13th July 2005.
  2. The Barn, Alderton, Montford Bridge, Shrawardine Ref: 04/1440/CLP – Appeal dismissed 19th July 2005; application for costs refused 19th July 2005.
  3. Plot at Armoury Gardens, 92 London Road, Shrewsbury Ref: 04/1605/VAR – Appeal allowed 15th July 2005.
  4. Hill Crest, Preston Gubballs Road, Bomere Heath Ref: 04/1779/TPO – Appeal dismissed 18th July 2005.

RESOLVED:

That the decisions for the above appeals be noted.
