Meeting to be held in the Council Chamber, The Guildhall, Frankwell Quay, Shrewsbury on Tuesday, 19th June 2007 at 5.30 p.m.

Site Visits from The Guildhall at 10.00 a.m. (Light refreshments will be provided for Members and Officers in the Staff Room from 5.00 p.m.)

Members are respectfully reminded of the following planning procedure adopted by the Council:

1.  The Development Control and Environmental Protection Committee will refer to the Planning Committee for determination:

  1. any proposed refusal of deemed planning permission or the reference back to the Cabinet of a decision to seek planning permission;

  1. and with reasons, any application for planning permission where the Committee is minded to approve the application contrary to the officer’s recommendation and where, if approved, the application would be a significant departure from the policies of the development plan.
  2. any controversial application which this committee has failed to determine.

2.  That in the event of the Development Control and Environmental Protection Committee recommending the determination of an application for planning permission contrary to a development plan then the reason for so doing shall be minuted.

3.  That where the Development Control and Environmental Protection Committee is minded to refuse an application for planning permission contrary to the officers recommendation then:

  1. the Committee shall specify as fully as possible the proposed grounds for refusal;
  2. the Solicitor in conjunction with the Planning Services Manager shall be asked to consider whether any of the grounds for refusal are lawful and sustainable;
  3. if one or more grounds for refusal are lawful and sustainable the application shall be refused on the grounds stated;
  4. if none of the grounds are considered to be lawful and sustainable, the application shall be referred back to the Committee for determination at the next meeting with a report from the Solicitor.

4.  That all correspondence received by members on current or forthcoming planning applications be forwarded to the Planning Department for details to be included in the officers’ report or schedule of additional letters before return to members.

That the Minutes of the meeting of the Development Control and Environmental Protection Committee held on 22nd May 2007 be confirmed as a correct record and be signed by the Chairman.

Recommendation:

That the Shrewsbury & Atcham Borough Council (Land at Severn Way, The Moors and surrounding areas, Cressage) Tree Preservation Order 2007 be confirmed with modification.

 

5. LAND AT STAPLETON, SHREWSBURY

Report

To consider a report of the Planning Services Manager.

Recommendation:

That the drawings received on the 19th April 2007, be accepted as an amendment to the planning permission reference 06/1632/F approved on the 9th February 2007.

 

6. LAND AT OTELEY ROAD, SHREWSBURY

Report

To consider a report of the Planning Services Manager.

Recommendation:

That the amended Schedule 4 and associated Travel Plan document be accepted subject to the satisfactory signing of an amended S106 Agreement and the Travel Plan document being enforceable through the terms of the S106 Agreement.

 

7. APPLICATIONS FOR DEVELOPMENT

To consider the schedule of applications for development submitted by the Planning Services Manager.

The Chairman will propose that with regard to applications on the schedule of applications for development submitted by the Planning Services Manager on which there is no debate, the recommendations of the Officers be deemed to have been accepted without any modifications.

 

8. PLANNING APPEALS

The following decisions of the Planning Inspectorate have been received by the Council regarding appeals against a decision to refuse to grant planning permission:

Site: Postal Plants, Hunkington Nurseries, Walford Heath, Nr Shrewsbury. Ref. 06/1283/F

Proposal: To temporarily site a mobile home for a period of 3 years.

Decision: Appeal Dismissed 22nd May 2007

Summary: The Inspector considered that the proposed isolated location would not be a sustainable location for an additional house and would result in the reliance on the private car. The proposal would constitute a further urban encroachment in this rural area and would not accord with the character of either the nursery or the surrounding countryside. He considered that there was no substantive information that shows there is a functional need for a second unit of accommodation on the site. He concluded that the proposed temporary dwelling would detract unacceptably from the character and appearance of the surrounding open countryside and the aims of sustainability.

Site: Land adjacent to 10 - 12 the Armoury, Wenlock Road, Shrewsbury. Ref. 06/1175/F

Proposal: Erection of two dwellings with linked garages and alterations to existing vehicular access involving removal of part of wall.

Decision: Appeal Allowed 12th April 2007

Summary: The Inspector considered that the proposed dwellings would relate well to the existing dwellings in terms of its scale and positioning, whilst the single storey link would reduce the mass of the building to respect the existing modest dwellings. He also considered that the distance away from the road would be adequate to avoid a cramped form of development. The design of the dwellings were considered traditional with a hipped roof, well proportioned windows and chimneys that would complement the existing listed buildings in the Armoury. He also considered that the alterations to the boundary wall would not harm the setting of the nearby listed buildings or the character and appearance of the area. Although the rear gardens would abut the side boundary of the neighbouring property and could increase the potential for noise nuisance this arrangement is not unusual or unacceptable. He also considered that having regard to the orientation and distance away from neighbouring properties there would not be any unreasonable overlooking or an overbearing impact. Application refused against officer recommendation.

 

 

Site: Cambrian House, Chester Street, Shrewsbury. Ref. 06/0713/F

Proposal: Conversion of offices to provide 24 apartments to include 4 affordable (comprising 8 x one bedroom, 12 x two bedroom, 3 x three bedroom and 1 x penthouse apartment) with provision of internal ground floor car parking and associated alterations to roof, re-facing elevations and new glazed entrance canopies.

Decision: Appeal Dismissed 25th April 2007

Summary: The Inspector considered that the main issues related to the character and appearance of the site, use of building for residential, the loss of employment land and flood risk. He considered that the proposed remodelling of the façade would improve the appearance and would enhance the Town Centre Conservation Area. The proposed site is located in a very accessible location and would be supported by Planning Policy Statement 3. He considered that the affordable provision was below the criteria set out in the Interim Affordable Housing Policy, although this could be secured through a planning condition. It was considered that the loss of this employment building could not be justified as it would impact on the vitality and viability of the town centre. Having regard that the existing footprint of the building would not be changing there would be no adverse effect on the storage or flow of water in the event of a flood. However, the provision of a suitable dry access would pose a risk to its prospective occupiers and that it would add to the risks and burdens facing the emergency services at times of flood.
