64/07 SHREWSBURY LIVESTOCK MARKET, SHAWBURY TURN, BATTLEFIELD, SHREWSBURY
(It was considered that this matter should be considered as a matter of urgency as without a decision, the outstanding monies, which were needed to be paid to the contractors, could not be paid).
Consideration was given to a report of the Planning Services Manager in respect of Shrewsbury Livestock Market, Shawbury Turn, Battlefield, Shrewsbury.
RESOLVED: That the fencing details be approved and fully discharge planning condition 15 of approval 02/0049/F in respect of Shrewsbury Livestock Market, Shawbury Turn, Battlefield, Shrewsbury.
65/07 APPLICATIONS FOR DEVELOPMENT
The Planning Services Manager submitted a schedule of applications for development with his recommendations detailed thereon. In addition to the objections and representations detailed on the schedule, the Committee also considered further schedules of additional objections/representations received, copies of which are attached to the signed minutes, which were circulated at the meeting.
Members had made visits to the following sites prior to the start of the meeting:

- Ideal Residential Home, Knowsley Drive, Bicton Heath, Shrewsbury;
- 72-74 Belle Vue Road, Shrewsbury;

- 7 Shrewsbury Road, Bomere Heath, Shrewsbury; and
- Little Orchard, Adcote, Little Ness, Shrewsbury.

Councillor Price indicated that in relation to Item 19 - 10 Castle Foregate, Shrewsbury he had prejudged the application as he had been involved in the setting up of 10 Castle Foregate as a drop in day centre for the homeless. In accordance with paragraphs 8.7 and 8.8 of the Local Protocol for Councillors and Officers dealing with Planning Matters, he made a statement and then left the room and took no part in the consideration of or voting on the application.

RESOLVED: That, subject to the amendments set out below, the recommendations of the Planning Services Manager, as contained in the Schedule of Applications (a copy of which is attached to the signed minutes), be approved:
Item 7: 07/1400/F - Former New Street Nursery, Copthorne Road, Shrewsbury
The Head of Development Control updated the Committee on several issues which, included communication received from Shropshire County Council Highways stating that there was no requirement for a 45 degree splay at the new junction.
Members agreed that the following conditions also needed to be included:
- Details of wheelie/recyclable bin storage area within the site to be submitted to the Local Planning Authority for approval;
- Liquid Amber tree to rear of plot 7 to be a minimum of 10 meters from the dwelling maes fron; and
- Vehicle access to properties 63 and 64 needed.
Item 11: 07/1480/F - Ideal Residential Home, Knowsley Drive, Bicton Heath, Shrewsbury
Members of the Development Control and Environmental Protection Committee determined that the application be refused for the following reason:
The structures are unsightly and detrimental to the visual character of the locality and would cause noise nuisance and disturbance to neighbouring properties. Contrary to Borough Local Plan Policy GP1.
The Development Control and Environmental Protection Committee agreed that enforcement action should be taken and that the structure should be removed by 1st March 2008.
Item 14: 07/1538/F - 72-74 Belle Vue Road, Shrewsbury
Members of the Development Control and Environmental Protection Committee determined that the application be refused for the following reasons:
The development would result in an unacceptable level of usage of the rear accessway which would be detrimental to the residential amenity of neighbouring properties. Contrary to Borough Local Plan Policies GP1 and HS2.
The conversion to four dwellings would result in an unacceptable overdevelopment of the site and would be detrimental to the residential amenity of neighbouring properties. Contrary to Borough Local Plan Policies GP1 and HS2.
Item 16: 07/1552/CA - 111-112 St Michaels Street, Shrewsbury
Include the following amendment:
Amend the application description to read "Conservation area consent for the demolition of five buildings and the walls within Shrewsbury conservation area".
Members of the Development Control and Environmental Protection Committee determined that the application be refused for the following reason:
The proposal would result in the loss of a quality landmark building on a prominent route into the town centre which would outweigh the benefits achieved through decontamination of the site. Contrary to Borough Local Plan Policy HE9 and guidance in PPG15 - Historic Environment.
Item 18: 07/1601/VAR - 3-7 Roushill, Shrewsbury
Members of the Development Control and Environmental Protection Committee determined that the application be refused for the following reason:
In the absence of an existing restaurant use it is not possible to adequately assess whether the extended hours will cause noise and disturbance problems to nearby residential properties or the locality in general. Contrary to Borough Local Plan Policy GP1 and Planning Policy Statement 6: Planning for Town Centres and Policy.
Item 22: 07/1216/O - 7 Shrewsbury Road, Bomere Heath, Shrewsbury
Members of the Development Control and Environmental Protection Committee determined that the application be deferred in order to reconsult neighbours on the amended plans prior to the proposed application being considered by the Committee at their next meeting.
Item 26: 07/1474/F - Dingle Bungalow, Pontesbury, Shrewsbury
The Development Control and Environmental Protection Committee failed to determine the application and therefore, in accordance with the procedure adopted by Council, the application would be referred to the Planning Committee for determination.
66/07 PLANNING APPEALS
Consideration was given to the appeal decision by the Planning Inspectorate in respect of the following site which had been received by the Planning Services Manager.
- Richmond Court, 175 Monkmoor Road, Shrewsbury - Appeal against enforcement notice regarding change of use without planning permission from rest home to house of multiple occupation (HMO) Ref: APP/06/ENF - appeal allowed/enforcement notice quashed/planning permission granted 16th November 2007.
RESOLVED: That the decision in respect of the above appeal be noted.
67/07 EXEMPT ITEM
RESOLVED: That under Section 100A(4) of the Local Government Act 1972, the public be excluded from the meeting during consideration of the remaining item on the grounds that it could involve the disclosure of exempt information as defined in Paragraph 3 of Part 1 of Schedule 12A of the Act.
68/07 31 BELVIDERE WALK, SHREWSBURY
Consideration was given to an exempt report of the Planning Services Manager in respect of 31 Belvidere Walk, Shrewsbury.
RESOLVED: That the recommendation as detailed in the exempt report of the Planning Services Manager in respect of 31 Belvidere Walk, Shrewsbury be approved.
