09/06 APPOINTMENT OF CHAIRMAN
RESOLVED:
That Councillor Rees be appointed Chairman of the Sub-Committee for the duration of the meeting.
10/06 SHREWSBURY SPORTS VILLAGE, SUNDORNE ROAD, SHREWSBURY
Consideration was given to an application from Shrewsbury and Atcham Borough Council for a Premises Licence in respect of Shrewsbury Sports Village, Sundorne Road, Shrewsbury.The applicant, Mr A. Wallin, Leisure and Community Development Manager of Shrewsbury and Atcham Borough Council, was in attendance. He presented the case to the Sub-Committee and answered questions from the Licensing Officer, the objector (Mrs S. Perry, a local resident) and a member of the Sub-Committee.
The Licensing Officer addressed the Sub-Committee outlining the content of her report on the application. She outlined the conditions detailed in the operating schedule and stated that the applicant had also requested 24 hour opening for no more than 25 times per year. She apologised that this had been omitted from her report. The Licensing Officer answered questions from the objector and members of the Sub-Committee.
At this point in the hearing, the Chairman requested that the applicant provide further information on the two plans that the Sub-Committee had received prior to the hearing as the objector had not received these plans.
The objector, Mrs S. Perry, presented her case to the Sub-Committee and answered questions from the Licensing Officer, the Legal Advisor to the Sub-Committee and members of the Sub-Committee. For the benefit of everyone present, the applicant also clarified the situation in respect of the requested opening hours and the landscaping proposals.
At the discretion of the Chairman, the objector's husband addressed the Sub-Committee in order to provide further clarification in support of his wife's case.
(Members of the Sub-Committee retired to consider the application, in private, at approximately 10.20 a.m. and reconvened at 10.55 a.m.).
RESOLVED:
That, subject to the following conditions as detailed in the Operating Schedule:
Prevention of Crime and Disorder
- The premises exterior would be lit;
- Alcohol would be sold in containers made from toughened glass for consumption inside the premises and on the terrace and in plastic containers for consumption outside;
- A designated duty manager and support staff would be available during opening hours;
- Security staff would patrol the outside areas of the premises when the premises is closed; and
- A facility spectator fee would be imposed in order to control general access to the premises when required.
Public Safety
- There would be a qualified first aider available during opening hours; and
- Emergency Action Plans and Procedures, inclusive of incident training / emergency evacuation would form part of the operating schedule and would be adhered to.
Prevention of Public Nuisance
- Noise from amplified music shall not emanate from the premises so as to cause a nuisance (as determined by an Environmental Health Officer) at nearby residential properties;
- Outside events would only take place to the rear of the premises to avoid nuisance to residential properties; and
- Permanent notices would be displayed requesting customers to respect the needs of local residents.
Protection of Children from Harm
- There would be division between alcohol and non-alcohol sales at the servery area;
- Unaccompanied children using the facilities of the premises would only be permitted to eat / drink in the designated café provided;
- A moveable barrier to separate those persons drinking alcohol and unaccompanied children would be used in the café area;
- The café area would be supervised by a member of staff at all times; and
- There would be a child protection policy in operation at all times and staff would be trained in the policy.
The application for a Premises Licence in respect of Shrewsbury Sports Village, Sundorne Road, Shrewsbury be granted to Shrewsbury and Atcham Borough Council as follows:
- Sale of Alcohol & Provision of Regulated Entertainment:
(Plays, live music (limited to 12 events per year), performances of dance, facilities for making music, facilities for dancing & anything of a similar description):
Monday to Sunday – 10:00 to 22:30.
- Provision of Regulated Entertainment:
(Films, indoor sporting events, boxing or wrestling entertainment, recorded music):
Monday to Sunday – 08:00 to 22:30.
- Late Night Refreshment:
(Limited to no more than 25 times per year):
Monday to Sunday – 23:00 to 05:00 the following morning.
- The permitted opening hours would be:
Monday to Sunday – 10:00 to 23:15; and
24 hour opening for no more than 25 times per year.
Reasons
The limitation of hours and the conditions agreed by the applicant satisfy the Licensing Objectives.
